I have a friend who has been denied political refugee status in New Zealand with decision of the RSAA and now he is under threat of being removed from New Zealand. Currently he is under police custody and waiting for a decision to be taken on his case regarding his removal. His lawyer has appealed against removal.
I would like to have information on the removal procedure:
- how long can a person be detained before being removed?
- can he choose to be removed to a third country (for example his wife's country, which does not require for him a visa) instead of his homeland?
-has he the right of been informed about when (which date, time..) the final removal will be executed?
- which is the most recent law applied on this subject? Immigration Act 1987 No 74 (as at 02 August 2010)?
- once he has been removed from New Zealand, does the removal imply limitations for immigrating in other countries (such as Schengen countries or US or Canada)?
