jamaican national entered on Working Holiday Visa

I have a friend who is Jamaican, entered UK in 2001 on a working holiday visa (WHV) which expired on march 2003, subsequently the person applied for a student visa as she was continuing her further education in Health & Social Care (NVQ level 2 & 3).

Her employer applied for her work permit on the TEWS scheme, but was rejected as she did not have a ceritfication at that time for her NVQs. She is now about to receive the ceritifications due within the next 60 days. Further her student visa expiresd on 31st July 2004.

Please advice on the following:

On which basis can she now apply for extension of stay in uk as she is still awaiting her certificates.

As she entered UK on the basis of WHV, when jamaica was still a non-visa country, which subsequently became a visa country during her stay in the UK, hence would her employer would now be allowed to apply for a fresh work permit on the basis that she has or soon will be receiving her full ceritification.

Please further clarify as to whether the 3 year residency category for home student fees for UK based nursing degree programmes would be applicable in her case as she had been resident in the UK for the first 2 years as a working holiday visa holder and hence was not in the uk for the sole purpose of receiving higher education.

1. Your friends employer can submit a fresh TWES application based on the new qualification. This should be submitted before your friend's LTR expires.

2. Your friend will be entitled to pay Home Fees is she is one of the following:

1. UK citizen
2. UK ILR
3. EU citizen

who has been resident in the UK / EU in the last three years during which she did not study in a higher education establishment.

-or-
1. A recognised refugee.
2. As student in a student exchange program.
