ILR for Intra company transfer

ILR for Intra company transfer

Guys,

I have a small question whoever got Tier 2 visa under Intra company transfer (ICT) after 6th apr 2010 is these guys are eligible for ILR after 5 years or home office removed this type of visas from ILR.

The intra-company transfer route, which is not part of the annual limit, will also be changed in 3 ways:

* the job will have to be in an occupation on the graduate occupation list;
* only those paid £40,000 or more will be able to stay for more than a year. They will be granted for 3 years with the possibility of extending for a further 2; and
* those paid between £24,000 and £40,000 will be allowed to come to the UK for no longer than 12 months, at which point they must leave and will not be able to re-apply for 12 months.

If you applied under the Tier 2 (Intra company transfer) category before 6 April 2010, or if you switch into that category from being an intra-company transferee work permit holder, you can apply for settlement when you have been here for five years.

The full changes to settlement is not yet announced. Currently ICT workers can apply for ILR after 5 years. Not sure if that will be the same after April 2011...

EDIT: it has been confirmed that long term ICT workers after april 2011 cannot settle in UK after 5 years and must "leave" (cant switch into tier 2 general either)

What was the immigration status of the applicant before 06-Apr-2011? If the applicant was already in UK on a WP (ICT) or Tier 2 (ICT) before 06-Apr-10, then the applicant may be eligible for settlement under current rules.

Thanks for your reply.

Applicant came to uk after 6th apr 2010 on 3 years ICT visa so if wants to settle in uk and he can't do this at the moment.Is it possible for him to move from ICT to tier 1 general ( his salary is more than £40k)

The period spent in UK as Tier 2 (ICT) migrant, where Tier 2 leave was issued after 06-Apr-10, cannot be included in the qualifying residential period when applying for settlement as a Tier 1 (General) migrant (245E(viii)) .

However, if the applicant wishes (for other reasons) he may switch to Tier 1 (General) before 06-Apr-2011, if he qualifies for it.
