appeal allowed now what?

appeal allowed now what?

Hi

my student visa extension was refused so i appealed against the decision finally my Tier 4 appeal has been allowed. i have received written determination about 3 weeks ago.

my 1st question is : can any one tell me what will happen next about issuing me extension and how will it happen and how long will it take?




next week i will complete my 10 years as student in UK, i am going to apply Indefinite leave to remain on the basis of 10 years lawful long residence.

my 2nd question is: do i have to wait for UKBA to implement the appeal decision ( do not how long they will take) or can appeal before the implementation?

Be prepared to wait atleast 3 months or even more before ukba implement the appeal.

Can i just ask what reasons did they give you for the refusal?Call me a skeptic but UKBA knew you were about to complete 10 years lawful residence and they used some fibble excuse not to renew your visa.

I am still waiting almost 3 months for UKBA to implement the appeal.

Maybe someone will see sense in your case and grant you ILR instead of a few months or years extension.

they are not going to grant ilr as the op did not apply for ilr.

You need to call the tribunal to make sure ukba hasn't applied for permission to appeal.

If they haven't then you need to send a copy of the determination to the casework unit who originally refused your application and ask them to implement the decision. It can take anything from a few weeks to a few months.

It would be better to wait until you have your residence permit back before you apply for ilr.

I was in the same boat last year. My student visa was refused in March 2010. I appealed, and this was allowed on 12 August 2010. I was due to complete 10 years in UK on 29 Sep 2010, so in theory I was entitled to apply for ILR on 03.09.2010, which is what I did. UKBA accepted my ILR application even before issueing my residence permit, as I included a cover letter stating that the time for them to challenge the appeal has lapsed. My ILR was granted on 15.11.2010.
To cut the story short, you might want to apply for ILR now, but to be on the safe side, wait until your residence permit has been issued.
