Tier 1 (General) Extension with Dependent [URGENT]

Dear All,

I am due to apply for my extension within 1 month...

My wife came in this country on 5th January and i opened her bank account after 1 week.

I deposit £1500 into her bank account as i thought £1500 was the amount which she needs to have in her account to show the maintenance fund.

But now i have realized it was actually £1600 so i just put £500 extra now into her account which makes the total £2000 in her account.

So today is 11/03/2012 and i am applying next month 11/04/2012..

How do you see this issue as that won't fulfil the requirement of having £1600 more than 3 months ?

Can anyone help on this please or recommend anything ?

Hello .,, I have question as well I m apply at end of may I m showing my wife maintenance through my account I have balance 2500 £ more then 4 months is it ok for her and for me thanks

I may be confusing but does it really need to be in my wife account (£1600)

I have over £10000 in my bank account from the last 6 months so do i still need to maintain £1600 in my wife's bank account from the last 3 months ?

I think u can show either account, in my case I just showed my account.

I m in Uk more then 5 years but my wife came in July 2011 and I m going to apply in may 2012 ... For ext I m bit confuse about maintenance can u still show through my account ant what amount she need for her maintenance ?

first of all I suggest you to read the UKBA guidance book carefully again and again and again and again and again please.............. to clear any doubts about tier1 general extension and dependent visa extension.

in your case ,as you have mentioned that you have more than 10000 pounds from last six months ,so you can use your bank account for maintenance funds.get last three months bank statements from your bank .

if you (the main applicant) are more than 12 months in uk than you need 800+533 per month,where 800 for main applicant and 533 for dependent for last three months.

if you are less than 12 month,than you need 1600 per month.it is written clearly in guidance book.

Family member of a tier 1 Migrant (excluding tier 1 investor dependants)

42. If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom
for less than 12 months, each family member of the Tier 1 Migrant must show that he/she, the Tier
1 Migrant, or (for children) his/her other parent who is also legally present in the United Kingdom
has at least £1600 to support him/her; this is in addition to any funds the Tier 1 Migrant needs to
prove he/she has enough money to support himself/herself. Please note dependants of Tier 1
Investors do not need to satisfy the maintenance requirement.
43. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, each family
member of the Tier 1 Migrant must have £533 to support himself/herself.

Just to add on whats already been said-

You can use your account, and in fact this works better
If you are in the UK for more than 12 months, YOU NOT YOUR DEPENDENT, you need £800 for yourself and £533 for your partner.
An [Expensive] Immigrant journey has ended 19/08/2015. Good luck to you all out there...

Hi All,

Thanks for the information. I have one quick query, I hope you can help me.

My info: I have Tier1 and my wife is my dependent, her visa obtained the same time when I initially applied. We were blessed with a baby towards the end of Jan 2012, for whom I am need to apply for Tier-1 Dependent from India (Both mother and child in India at the moment). I came to this country on Apr 2nd 2011 and I have visited India for about 7 days in Dec 2011 and about 3 weeks in Feb 2012. Please note only child needs Tier-1 Dependent visa.

Question:
1)Will I qualify for one year criterion when it comes to maintenance fund on Apr 2nd 2012? Since i have gone out of UK for about 28 days since I first landed here. How does the count of one year work?
2)How much do I need to show as maintenance fund? Is it
a) £533 - Just for my daughther on or after Apr 2nd 2012.
b) £800 + £533 + £533 - For me + wife + child.
c) £800 + £1600 + £1600 - For me + wife + child.
d) £1600 - Just for my daughter assuming I have not completed one year on or after Apr2nd.

Kindly help with question 2) since I am bit confused and i am bit short on funds. I have maintained about £1800 only since I was thinking I will fall in either category a) or d). One of my friend suggested me to maintain for all dependents including myself (i.e) either b) or c). When i read the maintenance fund requirement this is not very clear on how much we should maintain.

hi there,
as you are less than 12 months in UK after tier1 visa,your maintenance funds requirement shall be 1600+800 for one child.(child+main applicant)
I suggest you to wait until 2nd April and make application after completing 12 months in UK .than you shall need £533+£800 only.

your 12 month time period shall complete on or after 2nd April, regardless how many days you spent in India.

Thanks for your reply. If i read the guidance document, point no 46, page 10/22 its bit contradicatory to what you say. Please correct me if i am wrong, and I pray I am wrong.

46. If a family member applies separately from the Tier 1 Migrant, there must still be enough funds to support each member of the family. Therefore in the example above, if the family has a third child, the main applicant has been in the United Kingdom for two years and the family applies for leave to remain for the third child separately, they must provide evidence that they have an additional £533 in available funds.

I have highlighted in Bold where it says additional £533 in available funds. Will that additional means as given in example £2399 + £599 ? Very confusing :( and please clarify

It means,
if less than 12 months or more than 12 months:

main applicant+1 dependants =800+533 0r 800+1600
main applicant+2 dependants=800+1066 or 800+3200
main applicant+3 dependants=800+1599 or 800+4800 etc etc
etc.............and so on.

I applied from Pakistan in February 2011 for my wife and son ,while I was in UK. I maintained 800+533+533 for three months and my family got visa without any trouble.as far as I understand from the guidance book that when you apply for a tier1 dependent visa,main applicant should also maintain 800 pounds in both ways ,applying separate or together ,inside UK or out side UK,should maintain 800 pounds plus with NO of dependants.
