Mobile phone penalty + ILR

Hi All,

I am asking this question on behalf of a friend's wife. She was using a mobile phone while driving and was stopped by police. She was asked for her license and she was legally using her international driving license. She was asked for her DOB, name, address etc. A few days later she received a letter through the post about the traffic offense where she decided to plead guilty via post instead of going to the court in person. Months down the line she applied for the full UK driving license and got it, but there were no points taken off (probably the penalty wasn't correctly linked to her because she was using an int. driving license).... the question,

She has a BC spouse visa and is about to apply for ILR at the PEO, does she have to declare this offense on the form?
