Court summon treated in British Nationality Act 1981

Post by Riya123 » Tue Mar 19, 2013 2:45 pm

As I gather from the British Nationality Act 1981 (that is applied for applications submitted after dec 13'th 2012) that there is no concept of a conviction being 'spent'. I would like to know if having a court summon (for speeding) is still considered against the application, and if so, how long after the court summon could i be eligible to apply.

What was the sentence from the court? A fine and points?

Thank you for getting back on this.

Yes, I had the fine and points. I had it in 2 occasions,
2010- 4 points and £500 fine and then in Feb 2013- 4 points and £500 fine.

As the magistrate court convicted you will likely be viewed as having a non custodial sentence as opposed to having a FPN issued by the police. Therefore, you must declare these convictions and it is very likely tat your application will be refused for a 3 year period from the date of conviction as you are deemed to not have good character. You may still apply but with almost certainty you face refusal.
