Where is the guarantee that you will not be found out if you do not disclose?

I assume the offence was driving without due care and attention. Was the points and fine issued as a FPN by the police or by the court, if by the court, when?

and yes, it is driving without due care and attention. The accident happened more than 5 years ago

You'll have to declare it, it wouldn't affect your application per se. However, if the caseworker is sharp, they might see that's its not been declared previously and raise a flag. It's unlikely, however, the potential, perhaps extreme consequences, could be revocation of your ILR. I suspect your application would succeed.

exactly my thought... 50/50 really in this case. Would you personally recommend I get a lawyer?

I don't see how one would help. It's all down to how scrupulous the caseworker is.
