VISA Waiver - eligible? is there is risk?

I was born in Kenya.

I am married to a UK national.

I hold a full UK passport.

Two years ago whilst living in England on the Indefinite Leave visa in my Kenyan passport (before I was issued a UK passport) I applied to go to the USA for a short tourist visit. I applied for the visa beforehand, but my request was denied.

Now that I have a full UK passport, do I qualify for the VISA Waiver.

It looks like I might not from reading this:

'If you have previously been denied (refused) a visa, or have been found ineligible for a U.S. visa, you do not meet VWP requirements and therefore, cannot travel on the VWP.'

If so, I wish I had never applied before!

Can I risk travelling with my british partner under the visa waiver program anyway?

Do I need to apply for a full visa?

I disagree with the above advice. I suggest you apply for ESTA, declaring the previous visa denial. If your application for ESTA is denied, then you'll need to apply for a visa.

I have applied for an ESTA, declaring the previous visa denial. It took about 24 hours to be Approved.

My partners was approved immediately.


I am assuming that there will be questions upon arrival. The first leg of our air flight touches down from London in Chicago.

Will i definitely be stopped for questioning?
Should I take any extra documents with me?

Well it would appear that your ESTA has been approved, therefore I would not worry. Deal with any questions as they arise.

I was refused USA visa in 2001 and 2003. I am now British Citizen. What are my chances to get a ESA Visa Waiver?

I think the best thing to do would be to apply and find out.
