EEA Family permit - gives you work permit?

Post by habibcs » Thu Jan 23, 2014 4:48 pm

Dear members,

My query:
When an EEA spouse apply for EEA family permit and travels to UK with his/her partner from an EEA country - the EEA national as well as EEA spouse both used to get work permit automatically - Is there a change in that rulings from 2014?

Because on this page I see as:
http://www.ukba.homeoffice.gov.uk/eucit ... sibilites/
In section "Working in the UK" (previously: Employment)
It used to be "You and your family members can:" but now it is written as: "You can"
* seek and accept offers of work;
* work as an employee and/or in self-employment;
* set up a business;
* manage a company;
* set up a local branch of a company.

Can somebody please elaborate?

Thank you!

Nothing changed (apart from the website...). I don't know why they removed that part of the sentence but family members of EEA national are (and allways have been) allowed to work.
Check the FAQ before posting!
Citizenship (adults, children, passport)
EEA (EEA FP, RC, PR, Surinder Singh)

As others have pointed out, the right to work has not changed. It stems directly from the directive.

Thanks for the clear answer!
Can you be able to give the reference to the document and under which section it is mentioned?
Is this in "Directive 2004/38/EC" - which section? - Therefore it should apply equally to all EU member states and not just UK.

What is the meaning of "being self-sufficient" of an EEA national in order for non-EEA spouse to get residency if they both stay over 3 (or 6) months? [When EEA national is not student, not actively looking for job; but non-EEA spouse gets the job offer (because he is eligible under the given directive as you have just confirmed) so salary becomes the house income]

Yes, the right to work is explicit in the directive.
