The child can be registered as British. What is the mother's immigration status?
[/quote]

The mother is not in the UK at the moment and hasn't been for a while, she holds no status under immigration rules. She is resident in Portugal now.

The boy will need the mothers' consent to apply for registration until he is a minor unless the father has sole custody ordered by the court. Does the boy have pre-settled status now?
He has the mother's consent now but doesn't have a pre-settled status.

Prove Identity on UK ID Check for non Europeans

Hi Everyone, How is it possible to go through EU Exit ID Check if you are a non European trying to switch from pre-settled to settled status and they only give you an option to use your BRC or BRP but your BRC is expired as they all expired in Dec 2024? The message says you must use a valid document ...

Child Benefit while on pre-settled status (EU scheme)

Hi Everyone, If a person on a pre-settlement visa, dependent on a EU National, had a baby, but the baby is not an EU national and didn’t apply for a visa, is such person entitled for child benefit? Or should the person apply for a visa for the baby first? or maybe she is not entitled at all? Thanks i ...

Pre-settled to Settled - Send BRC?

Hello Everyone, When changing from pre-settled to settled status, is it a normal procedure to be asked to send BRC by post? And How long they normally take to return the BRC? All the documents were provided to prove the 5 years residency but they are also asking the person to send the BRC by post ...

Re: Proof of living in the UK

Should we send maybe 3/4 documents throughout the year? or 1 will suffice? I think we will add the Self Assessment statements just in case.

Re: Proof of living in the UK

You can use council tax or letters from other government agencies (eg DVLA, electoral register, HMRC). Tax assessments are not proof of residence, and I doubt letters from clients would be accepted. In the application process, they are requesting these documents "If you are an EEA National , you ...

Do you need a visa on your niece's other passport to go to the UK?
No, She doesn’t need a visa to travel to UK or Europe with her other passport. She’ll be travelling with her mother who is also settled in the UK.

Updates: So I have contacted HM Passports Office on Monday, and the passport has been returned indeed, they were gonna arrange a redelivery. 5 days have passed and no messages whatsoever, so I decided to call again but this time the agent couldn’t find any information. We have a trip booked for the 1 ...

Re: Royal Mail Returned my passport to HM Passport Office!!

If they had returned it to sender, then I think they acted too quickly . We’ll hold items for 18 days. If they’re not redelivered or collected in that time, we’ll return them to the sender. Recheck with Royal Mail again? Yes, That’s insane, as they first tried to deliver it on the 15th. Then on the ...

Re: Traveling with old BRC.

Assuming you mean "only BRC" = "passport and BRC". Yes, no issues there. She doesn't even need the letter; her status is linked to the old document (if she applied with her old BRC using the app, etc. producing the old BRC will show she has settled status). Even after replacing my old BRC with the ...

Are you guys receiving decisions by letter or email? I got confused as I’ve seen “decision letter received” on the timelines topic, but I’ve seen people reporting they’ve received an email. So I don’t know what to expect. This waiting is killing me 😩
