How much longer is it going to take?!

:( We have applied for FLR(FP) on the basis of Private Life and Parent. I am a British Citizen, my husband is Indian. The HO said that we was allowed to get married after we had a meeting in regards to how 'much we know each other', cannot remember what the process is called as it was a while ago ...

Re: What will happen next?

In which case the HO shouldn't request a DNA as your husband will automatically be considered to be the father of your child. It's simply a waiting game now, but it may take some time for a decision to come through. Great, thank you for your response. Feels like we're waiting forever! Actually very ...

What will happen next?

So my hubby is illegal, we have a baby and went through the solicitors who submitted an application under 'family' visa. He has had his biometrics done, and has paid the £500 NHS fees, what will happen now? The application was submitted in Nov 2016, would they ask for DNA of my hubby and our child? ...

I have been with my partner for nearly 5 years. We have a baby together who is a british national (I am British my partner is Indian). He has been illegal in the UK for 11 years. He has applied for stay using the FLR(FP). Just wondering what will his chances be of staying here?

Flr (fp) fee waiver rejected. Now what?

Hi everyone. Around feburary my partner applied for an flr (fp) application along with a fee waiver. I am due to have our baby next week and he just got a letter to say it has been rejected and that we need to seek legal advice urgently and submit a fresh application because they are now liable to ...

Re: H.O investigating 'sham' marriage?

If he returned to his home country he could apply for a spouse settlement visa as an unmarried partner, but as the sponsor you would still have to meet the £18,600 p.a minimum income level. We tried to explore that route, but I don't earn anywhere near that. When I was working (I am on ESA now due ...

Re: H.O investigating 'sham' marriage?

You should be aware that the right to family life won't be considered until after your baby has been born. Before then your partner leaves himself exposed to detention either at the interview or in one recent case although given permission to marry, Border Officers arrived at the Registry Office ...

Re: H.O investigating 'sham' marriage?

But surely they cannot detain him under the rights to remain in the UK with family, since his child (our child) is going to be born here, therefore a British citizen? I really hope that doesn't happen :( That falls into the area of a Zambrano case, which is very complex and requires specialised ...

Re: H.O investigating 'sham' marriage?

You may be given permission to marry or fiance may be detained, invited to leave UK or deported. There's also the question of how fiance supported himself and a whole family over the years. You can dig into legal ramifications here: http://www.cps.gov.uk/legal/h_to_k/immigration/ But surely they ...

Re: H.O investigating 'sham' marriage?

The HO may ask to interview you both separately before making a decision. A member recently reported that although the notification period was extended to 70 days, they were given permission to marry. IMHO your partner should have applied under FLR(FP) parent route not FLR(O), assuming that he has ...

H.O investigating 'sham' marriage?

Hi all. I am a British citizen and my partner is an illegal Indian and has been residing in the UK for 14 years. He came on a student visa for one year, then he extended it to a further 2 years I believe and when he tried to extend it again under a different category (cannot remember as he is not at ...

Hi all I am British Citizen, born and bred in UK. My mother was born in Britain, my Dad was also born in Britain. My grandparents were both born in Republic of Ireland. Re: Can my partner apply for discretionary leave to remain?

My partner and I have been together for nearly four years. We are in a very genuine relationship and we love each other unconditionally. Unfortunately he is an overstayer and has been for 7 years! He has been to the solicitors to try and get a visa but he has no grounds to apply so therefore he is ...
