i'm not a US citizen but i've applied from the US and last time they took only 2 weeks to give me a decision (rejection of course) but I applied for review on Oct 17th but hasn't been alloted to case worker yet.

wzhao1, if by visa you mean, your H1B visa stamp is expired, then you're still fine as stamp is just for entry, not for your continued stay. But if your H1B visa (i mean the approval -I797) has expired, obviously then your illegal (although I'm quite sure thats not what you meant) and can't get EC ...

what this means is at a stretch not more than 3 months and TOTALLING to less than 6 months in 5 years. In short, you get 6 months in 5 years to be out of the UK - use them as you want: 6 in one shot; 2+2+2; 1+1+1+1+2 or whatever takes your fancy.

I don't think problem is so much of not explaining clearly. The major issue is having to get a detailed letter through employer.
