Re: border control and EU's spouse without residence card

Thanks @kamoe and @Richard. Our marriage certificate was made in India but because France require its own registration, we also have a french family book ("carnet de famille"). Do you think this would facilitate entry and re-entry ? Actually the main worry is the return since if they refuse my wife ...

border control and EU's spouse without residence card

Hi all, As far as I know brexit did not yet happen so EU rules still apllies: A EU country can't refuse entry for your spouse if you are a EU member. We are planning to go to France to see family this summer but my wife sent her residence card for the EU application scheme. She still has her ...

I just called today and they said the application is in progress.

They told me they don't know how long it will take, saying 1 month, 2 months or even 6 months

By the way, for those that are in the same situation, and you did not yet started a mobile-based application, you should contact them first as they allows you to proceed with the mobile-based app. They told us to apply via the mobile app and answer that I was only French (basically not replying ...

Re: Application rejection : EU settlement scheme as a family member of an dual EEA / british

I agree with you that OP must apply under the regulations, but this is for a different reason. By applying under the regulations she can challenge unlawful decision, where as such rights are not applicable under the rules. Do you still think we should apply for the permanent residence card or ...

Re: Application rejection : EU settlement scheme as a family member of an dual EEA / british

Hey good news! I called the EU Settlement Resolution Centre again today and after insisting they replied to me that we can indeed reply yes to the question 3.40 ("Have they held British citizenship since they were born?") and still carry on with the application. The person on the call advised me to ...

Also if I managed to convince them to accept our application as EEA and they decline our application for whatever reason. Would I be able to try the permanent card residence path later ?

Thanks all for your replies. As for applying to permanent card residence. we were actually thinking to do so before and asked the forum here but people replied it was better to wait since settle procedure would be quicker (see https://www.immigrationboards.com/eea-route-applications/should-my-wife ...

Re: Application rejection : EU settlement scheme as a family member of an dual EEA / british

Yes, I mentioned to them the transition provisions of 2012, even named them accurately as I had our previous letter (send for my wife's latest residence card application) in front of me. (see https://www.legislation.gov.uk/uksi/2012/1547/made schedule 3 (part 2, subparagraph 3 and 5) ) And to ...

Re: Traveling in Europe in April 2019

Ok, yes just want to be certain :) Actually our children, while they are dual french/british, they do not have french passport nor a french id card. I was assuming it would be easy to apply for an id card but I just found out they require us to go to London in person (including the children) for ...

Re: Traveling in Europe in April 2019

Thanks for your reply

My main worry is whether the UK will consider the valid (non-expired) residence card to decide if my wife can get in the country after Brexit.

In other words, does its permanent residence status still gives her right to entry to the UK, after Brexit ?

Hi we are planning to travel in Europe in April 2019 just after brexit 2 years decisions. I am french/english and my wife is Indian. Re: Should my wife apply for a permanent residence card now?

Out of my own interest - given I want to know whether gaining British citizenship would affect my EU family members - through which route was your wife able to gain the Residence Card if you're British (& French)? Did you gain UK citizenship at birth or more recently? Can you direct me to a link to ...

Re: Should my wife apply for a permanent residence card now?

Thanks for the reply. As mentioned I know my wife's rights and she is definitely entitled to the permanent residence card if desired but wanted to get opinion simply in regard to the process and if it is better to wait brexit to finalize or not before wasting time and energy for the paper work. You ...

Should my wife apply for a permanent residence card now?

Hi, As the "brexit" withdrawal agreement is taking shape and the UK decided to put in place a way for current resident to apply for permanent residence, I wonder if my wife should wait when such system is in place (March 2019) or should she apply for the permanent residence card now to facilitate ...

I am writing a letter to support the mandatory reconsideration that is currently in process.

If someone could chime in to give answer and lin to relevant laws, this would greatly help me.

Thank you

Reading the child benefit manual now and it seems to indicate that even if my wife was under immigration control (which to my understanding she isn't) as they claim, she would be allowed child benefit : https://www.gov.uk/hmrc-internal-manuals/child-benefit-technical-manual/cbtm10140 under section ...
