You're not supposed to study full time with a tier-1 visa, you can only do part time. You might get away doing full time on tier 1 but I don't see a good reason to take the risk.

Can't you switch into some other visa?
Do you earn enough to be eligible for Tier1 visa?
If you arrange to switch into any other visa and stay until 2010 you may be able to get indefinite leave to remain based on 10 years legal stay. (if they don't change the rules by then).

Can they not go to 3rd country e.g Dubai on their Middle East passport and than use their Bitish passports to fly to UK. Many thanks to all who replied. They are from the Middle East.
Their father is a diplomatic personnel, he is not allowed to marry a foreign national, so they can't really use their british passports as long as he is in this job.

What would happen if they apply for a visa?

French embassy will tolerate visitor visa status for applicants for shcnengen visa, however they have to have more than 3 or 4 months remaining in their visa. check the french embassy in london website it's all in there.

is this mandatory in all countries? I've noticed this is the case in India, are all other countries the same?
