Re: messy situation re T2 dependent visa

He doesn't get the 60 days as she does? She's still on her T2. He doesn't ever want to lie - he was told he would have the same 60 days, and when hers became invalid (60 days after the letter, up to 28 days overstay) so would his. I just looked at the dependent policy guidance and it doesn't have ...

messy situation re T2 dependent visa

Right - I'm not sure where to even start. I'm a dual US/UK citizen. I naturalised in 2010. My OH is currently separated, but present in the UK as a dependent on his wife's T2. She up and quit her job on a whim, and I suspect is now creating herself a problem as she's gone to work for someone else ...

ILR and naturalisation after the new rules come into effect

I just decided to read up on the current bill as it stands as I was totally unsure how folks in my situation (ILR but now non spouse, non HSMP etc) would fare. The beginning of it reads: 39 Exceptions to application of this Part Nothing in this Part shall affect an application— 5 (a) which has been ...

New Rules and impact on those currently with ILR

I had started this thread elsewhere and it was suggested that I make a new thread of it so it wouldn't get lost. Recap: I have ILR and want citizenship. A few weeks ago the 'magic day' passed - but I am in the process of a divorce. On the form you can check 'legally separated' but the definition is ...

Good Idea - I will do that now.

What I never saw addressed is how they will handle future citizenship applications from those who had ILR when the new rules go into effect.

I was presuming that there would be no path for 'us' - but maybe I missed something. If there is a path I'm not nearly so fussed!

It does have a box for legally separated - but the definition is a bit vague (from the website) # Legally separated Living apart from a husband, wife or civil partner without divorcing or legally ending the partnership. No formal legal document is necessary to prove legal separation provided the ...

headache

This all gives me a splitting headache. I would have been eligible to apply for naturalisation a few weeks ago - however am in the middle of a divorce - I am considering putting the application in anyway with a letter attached explaining wanting to not get pitched out of the UK if the rules change ...

Re: The end of the 10/14 year settlement paths?

What do you think the fate of current ILR-ers is? I asked an immigration lawyer this morning and her response was that this new legislation will effect those who are immigrating and pursuing citizenship - I already have ILR, (I am done with the 'immigration' bit) - I may find it very hard to get ...

It is more point 3 that worries me. As it stands if I continue my divorce this legislatin will come into effect 24 days (assuming april 1) before I can apply - and there is no 'bucket' I'd fit into. I am going to try to putmy divorce on hold and apply in two months - I am v worried and do not trust ...

What really smarts is that if this goes into effect april 2009 (assuming april 1) that means I will be 24 days short of having been able to apply for citizenship despite the divorce. What if they decide I do not fit in to a category and they throw me out? I have a little boy I wanted to raise here ...

We will have to wait and see the legislation. Nobody's existing leave is going to be cancelled but what will likely happen is that people will get "transferred" from their existing leave to one of the new categories and will need to progress from there. What about those who do not fit so neatly? I ...

Losing ILR

Hi. Posted earlier on a different thread. I have had ILR for a bit but have been in the US checking out work/housing etc....and have been back/forth for a few months, being here for 4-5 weeks at a time. I really think I want to live in the UK. DH wants to live in the US. Conflict! If we were to live ...

confused about what I want to do

Hi. I am a USC who until v. recently was living in the UK with my UKC spouse (and our son, who is with me now). I had ILR when I left and have been going back/forth a couple of times in the last few months of being here. Even though my spouse really wants to come to the US, (has lived here on/off ...
