My HSMP/TIER1 lasted exactly 4 years and 11 months.... I had a ONE day window to apply and went to the Croydon PEO for my application EXACTLY 28 days prior to the 5 years. I received my ILR with no questions asked, but did bring along an email confirming it was ok for me to apply at exactly 4 years ...

I had the *same* problem which took me almost a year to get answers; expiring exactly 4 years & 11 months.
The answer is yes, you can apply for ILR...

With regards to having less than 5 years on your VISA, I had the same problem which took me almost a year sort out; expiring exactly 4 years & 11 months. The answer is yes, you can apply for ILR..
