Re: Missed out on 10 year route. Please help.

Hello Obie, thanks for taking the time to reply. It's been more than 6 months, continuous residency has been broken. I should have made it clearer in my post: I left with the UK on valid LTR after approx. 8 years of continuous residency, last in the Tier 2 Category, after I was made redundant. For ...

Missed out on 10 year route. Please help.

Hello there, I would really appreciate some guidance as to the options available to me for the shortest path to ILR. Briefly, I'm a relic of British empire- born in a former colony to mixed parents, brought up as an Englishman in a bubble world within the expatriate community including going to a ...

Being chased by Capita

Hello All, Situation: I'm being harassed by Capita, threatening me with deportation, more than a year after I already left the UK on a valid visa. The 'case' is being dragged out and I urgently need to visit the UK. Background: I was made redundant from my Tier 2 (General) sponsored job and my last ...

RLMT question

hello all, After a gruelling 7 stage interview process, I was offered a high level managerial position at the UK office of a global company. The company has known from the time of application, that I'm on a Tier 2 General visa, and would need to be sponsored for this job. After being offered the job ...

Incorrect advice being doled out here. In such situation, it is highly likely that rejection owing to missing information will be based on discretion by an immigration officer rather than clerical staff and this almost always happens after biometrics are enrolled. Second until immigration decision ...

Hi Shamino, It is very unlikely that your application will get processed within a week, the minimum is 2-4 weeks including receiving the approval letter. Why are you concerned that your company's licence will not be granted? As long as the correct supporting documents are supplied and the business ...

If you haven't got a sponsor licence by the time your visa expires: 1. ALWAYS make an application in time. 2. Write a covering letter explaining why the sponsor licence and COS information is missing, quote the licence application number. Include a letter from your employer explaining the situation ...

The suitable soc has to be selected. In my case, my code is professionals not elsewhere classified: there is always a code one can apply. Working on the premise that your employer is claiming it to be difficult to find a suitable code, is an excuse for being reluctant to sponsor in the first place ...

CoS status on SMS

Hi,

Once a Tier 2 application has been looked at by a caseworker, does the relevant CoS status in the Sponsor Management System change from 'Assigned' to something else?

I seem to recall some posts discussing this but can't find a source.

Thanks!

Manci- yes, you're right re rlmt, I didn't realise that the op is on PSW. I still believe that an employer is not obliged to sponsor when psw expires, if they have the slightest inkling that the position may not for whatever reason they have a concern about the position not meeting skill level rules ...

Has a rlmt for your job been carried out yet? If it has, the job centre assigns an soc code automatically. You could use this to argue that a particular code is applicable. I would rather suspect that your HR function is seeking to be very careful to cover themselves. Tier 2 can now only be ...

I would always recommend making an application in time, even if some information is missing and a good explanation is supplied in the form of a covering letter.

In the same boat. Savings being depleted. Nothing can be done. Best remain calm and keep yourself occupied. IMHO, they should allow people in this situation the option to work without a salary during the interim period, with a view to be paid in arrears once the paperwork comes through. But then ...

You can request urgent treatment as they say however you may not receive the licence in time as they take a terribly long time to actually send out the approval letter, that is to say assuming your company's paperwork is in order and no checks need to be made. You could try submitting postal ...

Yeah google RLMT, you'll find all the information you need. Unless your occupation is exempt (shortage occupation list), then you'll need to advertise for 28 days to ensure that there are no suitable EU candidates to perform the role. That's why it's important to wait until you accept the offer only ...

You'll need to wait for your BRP to come through and make a change of employment application. See the policy guidance which explains everything, including selecting the start date on the new CoS. Yes you have to join employer 1. If you don't turn up to work, they are legally obliged to inform the ...

They can only expedite the application if you have a good reason for it- eg. if the migrant has to leave the country within a week if he doesn't get a CoS and can't reapply for Tier 2 for a year under the cooling off period. If you're not in that a desperate position, then it's a waiting game I'm ...

if you read my post above, you would have noticed that if you currently have leave as Tier 2 established staff, you can switch to Tier 2 general, if you are applying to switch sponsors.

The rules say, 'currentlly has leave in..' , so if you changed your category after april 2010 from established to long term then you don't currently have leave granted under the previous rules.

You can ask a more experienced person whether long term qualifies, don't take my word for it.

I can confirm that one can indeed volunteer and study in such a situation. Supplementary employment would appear to be dependent on having an existing valid CoS and continuing to work for said employer. Curtailing of leave doesn't apply in my case as I was on a contract that was not renewed, rather ...
