Hi ashak, Thanks for reply. Home Office applied 322 (1A). As a false document has been submitted it is refused. The document was a letter issued by my business partner stating the earnings claimed. Refused Tier 1 General

Hi all, My Tier 1 (General) visa was refused with no right of appeal. One of the document was held forged. I am applying for student visa to Australia. In the form they need information regarding refused visas in past. Should I disclose this information to the Australian Immigration? Regards Sanjay.

they returned all the documents except one which details the earnings claimed (the same was held forged).

One of the document was held forged by UKBA. So they refused.

I wrote application for reconsideration along with additional documents to prove that the document is not forge. But no response from UKBA.

i read mirza and at point 15 of determination: SSHD is required to issue removal at the time of refusal no matter if the applicant is lawful within country. three months expired in Nov 2011. with regard to reasons for applying late, i was not legally represented by any solicitor. i was not provided any remedy to challenge this decision by UKBA, infact they said there is no right of appeal. i though there is no way to challenge it. i lost all the hope ...

three months leave has expired. but i can add few good reasons for applying late.

personally i am not in favor of JR because the judge can make a cost order against the claimant.

what is your opinion about cost order?

because my PSW visa was valid when UKBA refused my Tier 1 General.

so 82 (1) of 2002 act does not provide a right of appeal.

if you are in detention then you need to appeal within 7days.
if not in detention you can appeal within 12 days.

if you are not satisfied with the decision of tribunal.

N461 JR Claim Form

Who would be the interested party in case of filing JR in High Court against UKBA's decision of refusing visa?

Would it be the address where pre-action protocol letter should be sent?

Or

Would it be the address on the refusal letter received from UKBA?

Address of interested party is also needed to send a copy of pre-action protocol letter?

pre-action protocol letter is served to defendant before filing Judicial Review in High Court.

It was refused because you submitted the post dated bank statements.

You have to submit the bank statements of the same period when you applied for visa of your family. Neither pre-dated nor post-dated.

While Judicial Reviewing the UKBA's decision of refusing Tier 1 (General) visa if the claimant looses then approximately how much a claimant has to pay to UKBA?

In case if the defendant looses then will they pay the cost of the cliamant's solicitor?
