Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

I just wanted to post this. Today my wife received an email stating that the refusal decision had been reviewed and overturned by the Entry Clearance Manager. So not sure if it was the last email I wrote to them or the appeal itself. But whichever, my wife can now send her passport to Dublin and the...

Re: Surrinder Help please

I'm not sure if you are familiar with the Regulation 9 but here is the actual wording of the new version as of 01/01/2014 Regulation 9 (family members of British citizens) 5. For regulation 9, substitute— “Family members of British citizens 9. (1) If the conditions in paragraph (2) are satisfied, th...

Re: Surrinder Help please

Okay long story short my gf is non EU we have been in a relationship online due to this situation for going on 3 years now. She has visited me in the UK 3 times during this period for a total of 4 months. It is far from the shakey relationship it sounds and very genuine. Doing this online for so lo...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Radconn, where did you post your appeal to? Perhaps that would be the place to write to? Were you given any reference or case i.d. number? If so, I would try writing to the appeals address with your reference number and ask for a reconsideration. No harm in trying. I found this gov.uk link with inf...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

How about putting in a Freedom of Information to see if you can possibly get access to the information that you require? Alternatively, what about contacting the VFS/WorldBridge people (or whichever external body now deals with the visa applications in Dublin) and asking them for some contact detai...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Ask for a reconsideration where? I wrote to the ECM in Dublin and didn't even receive any acknowledgment, even though I sent it by registered post, and have a signature of the receiving person. There are no email addresses or telephone numbers listed anywhere anymore, they have all been removed. I ...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

gprit I think the main problem, especially for Brits, is the UK government interpret the Regulations whichever way they like. Then rely on the Appeal system taking so long to deal with cases. My own case is a point in question. My wife's visa was refused in January and it will be at the very earlie...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Thanks for the comments/advice. When I am in France March-June I plan to file tax returns there - I also (still) sometimes design websites in a self employed category. The website is a .co.uk domain and payments are made to me in sterling. Could this still count as 'self employed' as obviously I ca...

I'm not sure that they will accept part time work either under the new guidelines.
Seems that they would class that as temporary/casual work.

Re: Illegal entry into UK from Ireland?

As your previous FP has been refused on the sole ground of the centre of life, that expressly means you would have been deemed to be a qualified person under the old regulation, your application was submitted before the new regulation came into force but the ECO has ignored the transitional provisi...

Re: Illegal entry into UK from Ireland?

There is a poster called pablito on the board, I think he came to the UK via France whilst an appeal was still pending, you may either write to him to read through his post. I have not yet found anything definite but I suspect it will have not effect on your appeal. In fact you can come to the UK, ...

Re: Illegal entry into UK from Ireland?

Yes non EU married to British citizen, lived in Ireland with spouse then came to the UK, your case is different from mine now as the regulation has changed, that was why I suggested to follow your appeal through, if you made new application now, be it EEA2 or FP it will be decided on the new regula...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Hi Radcon, I too live in N.ireland. Am a non eea and been living in N.I 11 yrs. I have been on the ferry a few times couple of years ago. On the ferry from Ni to Scotland and I'm assuming to other parts of UK you only really need to show any of your photographic ID and ferry ticket. On board I have...

Re: Illegal entry into UK from Ireland?

Right I see what you mean. But there are cases where people do travel into the UK without the requisite visa and rely on being given access via the 1A stamp. If I read your earlier post correctly, is that what you did? So the only alternative is to make the trip and ask for entry at the port, I gue...

Re: Illegal entry into UK from Ireland?

Hi @Kristine015 I live in Ireland at present but we want to go to the UK to live. So her being classed as illegal and being made to leave would be the wrong way to go about this. Actually as far as going back into Ireland, she wouldn't be able to do that until she has her residence card issued or ap...

Re: Illegal entry into UK from Ireland?

I've thought about this situation recently as well. But one thought that has crossed my mind about this would be if you want to apply for an EEA 2. As I understand the rules, the documentation required is the same that you should have produced for the EEA Family Permit. So if they are not strong eno...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Thanks very much for your information.
I think I need to research some more as you suggest with the ferry company. If they won't even allow us on the boat, might be a problem there.

Moving up to NI wouldn't work because we live in Cork.

But once again thanks for your helpful input. Appreciate it.

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Not sure where in the UK you want to go, but you can always drive through Northern Ireland and then take the ferry across to Scotland and drive on to wherever your final destination might be. Dalebutt is right re: the rule. It is fine to do this. An EEA FP is not needed any way... Keep all your doc...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

I think you should create a thread or post your queries in one of the thread under the centre of life refusal. Going forward, in your situation I will book a flight, ferry or if I had a car drive into the UK and submit an application for EEA2. In your position I would not wait a further week since ...

Re: EEA FP Appeals

Does anyone know the answer to this please? I think my wife is able to reapply for the EEA family permit, while the appeal is pending. But we are appealing based on the fact that they assessed her application using Regulation 9 as of 01/01/2014 and we submitted the application in December 2013. So w...

Wouldn't they forward the letter to the UK?
Surely they cannot just ignore it. Or can they? Seems to me they are a law unto themselves.

hi just wanted to update what I have done. I have already appealed this decision, but I decided to try a more direct approach as well. Re: EEA FP Appeals

Hi Rosebead I had to do a paper appeal, because we aren't living in the UK. I could try and write them, but all applications from Ireland are now sent to the UK, so not sure where to write. I don't think they tell you the actual caseworker. I will have to see what I can find out though. It might hel...

Re: EEA FP Appeals

Hi Rosebead thanks for your response. I think he got it wrong as well. I actually found those transitional provisions and quoted them when I sent off the appeal. I am hoping that I have it right and he will change his mind, they have given him until the 25th April to get the documents back to the Tr...
