I called UKBA enquiry (0870 606 7766) today regarding this issue. The immigration adviser clearly explained me in detail saying that: " If the main applicant has switched from TIER1 to ILR, the dependants cannot remain on TIER1(Dependant) Visa even if they have a couple of months leave remaining ...

Thanks Obie and sushdmehta!! Obie, I'm sorry; I'm not criticising anyone; I just mentioned the link as the query was same in that case and this one but answers differ. And so was not sure as experienced guys/Gurus commented on both the threads. Regarding the rules, couldn't came across any UKBA docs ...

Thanks Obie! As the link below clearly says that PBS dependant cannot travel back to the UK (even though his/her leave is NOT expired) because the main applicant is on ILR now: http://www.immigrationboards.com/viewtopic.php?t=87206 Various conditions are mentioned in the above link by Gurus and ...

Hello Sushdmehta and Gurus, My query was: If we get ILR, can my child who is on TIER1(Dependant) visa TRAVEL to India and return back to the UK on the existing Visa (child's current Visa will expire after his return to the UK). Now, I've got the reply that 'YES' the child can travel back to UK on ...

Thanks. I'll read the guidance again.
I got to know from this Forum only that it is advisable to submit P60 or letter from HMRC having the similar details in case P60s are missing.

Hi sushdmehta

Thanks for your response.

I read the guidance document and P60 submission is not mandatory. This is just an evidence that you've paid taxes in the past 5 years and reflects tax/earnings etc in just one letter. But anyways, I m not in aposition to submit one.

Any updates on this please. As per HMRC, they don't have any Tax/NI records for me for the very first year. They do have it for the rest 4 years among the last 5 years. In such case, is it necessary to present HMRC letter of employment history to case worker?? I would appreciate if Gurus can share ...

Hi MrBrilliant

Basically you've been on WP for 5 years. And so any evidence from all the employers (in the form of payslips/letters) would do. Usually, this proof is not required from TIER1 (General) ppl as far as I know and so wanted to know your Visa category.

Thanks Vivdubes. Yes, you're right. The Indian company used to provide Indian salary and Indian payslips. But in UK bank account they just used to deposit money (call them allowances). So, basically no NI or IT was deducted at that point of time. And I was given FORM16 (UK equivalent of P60). I was ...

Hi D4109125 Thanks for your reply. But it doesn't answer my original query. ***Yes, the child has to travel immediately after our ILR is done. So, while traveling he will be on his current Visa only which is TIER1 (dependant) which is valid till Dec at the moment. Just I was not sure if he'll be ...

Hi Sushdmehta,

Thanks for looking into the post. I just created a new topic as my recent question is related to TAX/NI paid and NOT absences related. So, people can suggest in a new topic , at the same time it would be helpful to many other members. Can you please suggest. Thanks in advance.

Child's Visa status once parents get ILR

Hi, I've a kid on Tier1(dependant) Visa valid till Dec this year. If we get ILR in the coming month then what would be child's Visa status? Will it be invalid? Can my child go to India on current TIER1(dependant) Visa and come back to the UK before his Visa expires when we (parents) are on ILR? Any ...

Shace As you were not in the UK for quite a long period of time, it would be great if you collect enough evidence showing what you were doing away (or it was just holiday then some sort of related proof). In your case UKBA discretion would matter most. But I was away only for 6 days so again its ...

Hi salmanzz,

Thanks for the reply.
You mean to say that even though you had one absence of just 25 days you didn't complete section 6.1/6.2/6.3 in the form SET(O) which asks for entry/exit from UK and the reason.

Does UKBA not consider such form as incomplete?
Thanks.
