Re Application after rejection - Questions

Post by softwareluv » Tue Dec 06, 2016 12:41 pm

Hi,
I think it would be good to have one topic to clarify/discuss any doubts/questions while making fresh application after refusal for any reason.

Can someone answer following questions and also ask any other questions if anyone has:

1. If we are making fresh application after refusal within 14 days, should we answer Yes or No to following questions in application form?
K14; Have you ever stayed in the United Kingdom beyond the expiry date of your period of leave? (ht)
K18; Have you ever been refused entry clearance, leave to enter or leave to remain in the UK? (ht)

I think,
i. NO, if you applied on time and reapplying after refusal being within your 3C leave.

ii. NO, if you had never been refused in entry clearance before or viceversa.
This refusal was for your LR not nor the entry clearance.

Second question is not just for entry clearance. it says entry clearance, leave to enter or leave to remain in the UK.

That's the problem with learning answers by rote or supplying boilerplate answers rather than answering according to a particular applicant's specific case :!:

And for more complex, textual information (documents, business plans and the like) be aware that HO as a thoroughly modern 21st century organisation may well use document-checking anti-plagiarism type software to search for and weed out mass-produced templated types of responses.

Can someone please answer what do you think the answer should be if visa is expired while making fresh application after rejection and are under Section 3C extended leave to remain.
D6. Please note: You should only answer this question if your current visa or leave to remain has expired. Was there a reason beyond your control why you did not apply before your visa or leave to remain expired?
  • Yes You will have to provide evidence of your exceptional situation if you have answered ‘Yes’. Please see the policy guidance for more information.
  • No

Yes. You applied for the second time when your visa is expired. As soon as your first application is refused and completed after AR if you apply for it, your 3c is ended and . Then you are considered as overstayer and in regards to that question is Yes

If fresh application approved and one got extension for 2 years, how will this overstaying issue affect one's ILR application after completing 5 years of stay?
