Qualifying jobs and hours for Entrepreneur visa ILR route

Post by helpingperson » Tue May 26, 2015 8:29 pm

Hi

I have several employees working for my company, some are part time, some full time. Some of them stay few months, some less, some more.

How many hours do I need to apply for Indefinite leave to remain based on 10 full time jobs?

I also understand that 120 hours a month is considered as full time job for Entrepreneur visa, on this basis, if my company has employees who have done 14400 hours in 3 years time, all British employees, this is combined of part time and full time employees during 3 year period, Will this mean I can apply for ILR based on 10 jobs creation?

I also understand I don't have to employ 10 full time individuals to meet 10 full time jobs requirement for ILR, it is flexible and it is hours which I need to meet from part time and full time jobs creations.

Please kindly advise on this with any UKBA reference you have. Thanks a lot.

130 hours a month = full time

30 hours a week x 52 weeks = 1560 hours a year

1560 hours a year / 12 months = 130 hours a month

Hope that helps :)

Requirements ILR Entrepreneur extension accelerated route

Post by helpingperson » Tue Jul 28, 2015 9:31 pm

Hi

If we have created 10 jobs within 3 years, can we use same day service to apply for ILR?

Do we need to pass Life in the UK test to apply for ILR?

Would dependents be eligible to apply for ILR at same time?

What other requirements we need to meet to apply for ILR for accelerated route?

Your help is highly appreciated.

Thank you.

Hi

How long is life in the UK test valid for?

Our entrepreneur visa expires in July 2016, then we plan to apply for ILR on the basis 10 jobs creation. I want to have it passed well before time if it it is not issue for UKBA.

Thank you.

The test doesn't have an expiry.

ILR Eligibility for partners Accelerated

Post by helpingperson » Fri Jul 31, 2015 8:19 pm

Hi

I have been living in UK since 2007, mainly on student visa. In Oct 2013 I switched to Dependent of Tier 1 Entrepreneur , we registered our marriage in UK in March 2013 with registrar.

Eligibility for partners
You must have been given a partner visa and been living with your partner in the UK for at least:

2 years if you applied for that visa before 9 July 2012
5 years if you applied for that visa on or after 9 July 2012

My partner plans to apply for ILR next year on the basis of 10 jobs accelerated route, will I be able to apply for ILR as well at same time?

I am bit confused when I found above at Gov.UK website.

Could someone please advise and clarify as when I can apply for ILR?

Thank you.

5 years if you applied for that visa on or after 9 July 2012
No, you need 5 years residence as a PBS Dependent to qualify for ILR because you applied as dependent AFTER the above date.

If you meet 10 years long residence first in 2017, you can apply for ILR on that basis if you meet all the requirements.

Hi

Thank you for prompt response.

I am posting these questions under new thread as they are independent and in future will help everyone as easy to find.

My intention and logic both are to help myself and others.

You should keep to one topic/thread related to your ILR queries to avoid cluttering the forum with each question you have.

Hi

If we have taken IELTS already for previous visa application, do we still need to take English Language Test if applying for ILR under accelerated route?

Below is from gov.uk website.

If your qualification expires
Some qualifications on the Home Office’s list will expire after 2 years.

If you’re applying for citizenship and took the test before 6 April 2015, your qualification will still be accepted even after it’s expired.

If you’re applying to settle in the UK, your expired qualification may still be accepted as proof if it was one of the following:

previously accepted by the Home Office in connection with another immigration application, eg entry clearance
awarded in the UK and is on the Ofqual register
You need to confirm your qualification with either a certificate or by checking that your results can be viewed online.
