Right to work whilst at court of appeals

Hi moderators, gurus and members of the forum.
My appeal is at court of appeals and my employer did the right to work check on me which came back as negative.
I've made all the appeals within time called court of appeals this morning and was told that appeal is still with the judge for paper hearing. So my appeal haven't even been reviewed yet.
My question is do you have right to work whilst you have a pending appeal with Court of appeals?

Quick update

I've been suspended from work, I called ukvi 0300 number and I was told that last update on my file is that an appeal has been lodged.
Called the tribunal and was told that my case is still in line to be reviewed by the judge.
My employer sent another form to ecs got a reply within half an hour requesting for more information which was sent immediately.
Nothing since then.
My solicitor wrote an email still waiting for a response.
Everything seems to be in order.
Would appreciate any advice from you guys.

as far as I know and I could be wrong
right to work stays alive as long as 3C D cover an appellant this provision stops coverage on exhaustion at Upper tribunal. if you face decline from upper tribunal in anyways, lodge JR, approach court of appeal you do not have right to work however right to live in the UK may be different than your right to work.
you right to work is reinstated according to cat. your applied in and your appeal relates to if decision from court your end up with falls in your fav.

Hi thank you for your post, however I'm a bit panicked after reading your post.

You mentioned
exhaustion of appeal rights at upper tribunal (section 3C stops at exhaustion of appeal rights)

After doing a bit googling I found this. Please check page 12

Looking at above it seems like your appeal rights gets exhausted at court of appeals and until you have an outstanding appeal you are covered by section 3c

Please share your views.

How long process?

Now at court of appeal paper hearing any other option ?

@ Zaidii, section 3C continue until you exhaust all the appeal right which is at the court of appeal.

HO might have made a mistake by not updating their system to show that you are still pursuing your appeal at the court of appeal, but if you follow the call with HO, they will update your case on their system and you can then ask your employer to carry out the check again after the update.

Hi mates,

Can anyone let me know that how to confirm that either appeal has been lodged or not? I need any contact number where i can telephone them to make sure my appeal has been lodged/accepted.

My lawyer faxed appeal application to given address on appeal form but i am little bit worried that either it has been lodged and accepted properly or not!!!

Please guys let me know the procedure or phone number so that i can call them to make sure.

Thank you Olasunkanmi, because of the weekend I couldn't do much, my employer has sent another check on Friday. I'll keep you updated

Hi Rockey here's the number 03001231711
However if you've recently lodged the appeal you won't get any information calling that number as you'd have to quote your appeal reference number.
Normally you get a confirmation about fax recieved? That can be the proof
It may take few weeks before they take out fee from your account.

As i have not paid fees yet, my lawyer said me that we can pay latter when court will ask to do so ..

Anyways i got fax confirmation but i want to make sure they have received it properly. So how to get appeal number ?

Same here I am waitin for appeal reference number, solicitor filed the appeal via fax. I had a good job offer and lost the job because they changed my right to work to negative. I rang the Home office Employer checking and they said there is a delay uploading their system. Very nice considering that I had a job in line. Why they dont wait until the days allowed to file and appeal before they can change the right of work status is beyond me. Its such an inconvinience and playing around with people's livilihoods.

My employer recieved a positive response today, stating to ignore previous responses as they were sent due to an error while processing the checks.

@ Zaidii, good to hear that your employer got a positive response from HO. HO sometimes create problem for applicants by some of their lazy/unprofessional staffs and rubbish system.

I applied on the 8th of August, bundle approved 25th September.

Current Status: Awaiting a Judicial Decision on the papers.

Yes your 3C continue until you have your appeal rights exhausted.
If it gets denied at this stage you can request for the oral hearing at COA, until you get hearing or get dismissal, your 3C continues. After this there's no further right of appeal.

I have the same problem. My appeal is in court of appeal. But ECS sent negative response to my employer and they dismissed me from job. I contacted court of appeal and they said it is my responsibility to inform government legal department and home office. Is any one have idea where to inform and how to inform ?

My solicitor send my appeal to court first Tribunal on 8 Jan 2017 .
