2) contract not submitted however submitted invoices.

ANS: Yes submit the new CAR with paid invoice if possible.

i admit i forgot to submit the contract however as far as contracts are concerned, i submitted 3 service level agreement along with the invoice on the top of each contract, i recon they didn't pay attention to the attached contracts under the invoices each consisting of 14 pages.
anyway i challenged the decision and got a hearing date of 20th of Jan 2014 and Home office withdrew their decision on the hearing day, now after 2 months of withdrawal i have received a letter from Home office asking me to submit Current appointment report and contracts, it says you have submitted the invoices but we need contracts, i think again they have failed to look at the attached contract papers.

my confusion is what should i send them
new current appointment report or the one which i forgot to submit, but the old one is the printed copy from companies house website not the one ordered over the phone by paying £3, however i have already ordered the new one and should be receiving tomorrow, should i send both or the new one?

2) as far as contracts are concerned should i send them the renewed one or the old one which was submitted with the application ?
old one got expired in the month of june 2013 as it was 6 months contracts, now renewed ones are valid until june 2014.
which one should i send new one or the old one?

ANS: Send them renewed Contract and make sure your contract confirm the detail serviced provided by your business .... if possible write both business name and companies number and all other company information including email addresses and phone numbers.




3) what excatly they are looking in the contract as my company is an IT networking company and i have clients those who are small business not tech savy, so i set up their small network and other stuff whcih was mentioned in the original contracts, anything else or specific HO is looking for in the contracts?
kindly reply ASAP as i have to send all the docs by the 1st of April.
ANS: Details contract which shows the services provided by your company and general terms and condition of the contract between parties ....... also include payment details as well.

Technically you can't make a new application while you have an appeal waiting to be heard. Your new application will most likely be invalidated. You have 2 options
a)Withdraw your appeal or
b)Add your 10 year lawful residence status as an additional ground of appeal at the UT. The judge would grant you ILR through this option. It may be the cheaper option because you will only pay the difference between your initial application and the ILR but you may have to wait longer.

My advice is meet with your solicitor and explore all the options.

Waiting Time After Appeal Allowed

Hi,

How long do you wait to receive your documents (visa/Residence card/passport)from the HO after your appeal has been allowed? I had applied for a Discretionary leave FLR(O) in August 2012 which was refused but allowed in the First Tier Tribunal in April 2014 after I made the appeal. The determination stated that I qualify for the "parent route" and also I am not sure about the leave that I will be granted but the judge allowed the appeal under the immigration laws.

I received the determination on 7 April 2014, one week after the oral hearing at the court. The HO has all my documents and passport and my biometrics were taken after I had made the initial DL application in August 2012.

Hello shashin,
You can contact your MP for help. The HO is duty bound to reply to yr MP'S query, this facilitate the processing of your application.
Did you initially apply for flro or Tier 1?

Hello everyone today i want to share about my case..i am very surprised to received HO appeal against FTT judge decision because it's out of deadline to challenge.

Appeal Hearing Date: 20 Jan 2014
Appeal allowed (Determination promulgated) Date: 30 Jan 2014
we received allowed determination on: 3 Feb 2014
My solicitor received Notification letter from HO on 24 April 2014 that they are going to appeal against FTT judge decision.

MY QUESTION:

Does Home Office have right to appeal against FTT judge decision when it comes to crossed deadline? when Home Office challenge deadline was expired. My solicitor make a phone call on 10 March 2014 to the Tribunal they said HO hasn't appeal against FTT judge decision. we are process your appeal to BHC Soon. Again my solicitor make a phone on 21 April 2014 to tribunal they said your client allowed determination & relevant docs were forwarded to BHC. They will contact you soon. On 24 April 2014 my solicitor received notification letter from HO they are going to appeal against FTT judge decision. we are so surprised to received this letter because it's out of deadline to challenge. I am very stress on Ho appeal. what will be my further process ?? Is there anyone who have same situation like me...Please share your views on my case.

Thanks guys, I feel that home office nowadays just messing with us. They do nt know what they are doing its just
they have to refused us for no reason.

I wish each one of you a good luck and wish you all get your visas. I know its so so frustrating.
Plus solicitors Barrister fesses hard to pay. Just with the home office mistake i had to pay 6000k so far during my appeals
to solicitors or barrister whom to ask to give back now where is the justice for us.. They did with me twice nothing was
wrong with my case in the first place lolzzz..

I am glad to say that my 18 months struggle had a happy ending today
I received BRP, passport and other documents
the following time line might be helpful to guesstimate
Applied: 19 Nov 2012
Refused: May 2013
Hearing: 2nd week of Feb 2014
Determination letter allowing appeal: dated end of Feb 2014
Approval letter: 1st week of may
BRP and other docs: following day of receiving the approval letter
