Tier 1 50k route Please Help All Gurus

Hi All

I applied my entrepreneur visa on 21st of march 2013 with my team member.
had interwiew on 7 july 2013 and refused on 7 dec 2013.we awarded all 95 points but refused on basis of market research. appeal against decision had hearing on 5 sep 2014.
FTT refused our application saying not satisified from market research.
I applied for permission to go to upper tribunal on 23 sep but still waiting there decision.

My question is now.

I got married 10 oct 2014 with my british partner she earning 30k per year.
we living together now in 2 bedroom house.
what I need to do now if I want to go for marriage visa.
do I need to withdraw my appeal and what is the procedure.
my passport with home office since march 2013 and it will finish in dec 2014.

Please all Guru OLASKA and others help me this matter

@ HNJ, you can withdraw your appeal and then send in an application for partner of a British citizen. But it might be better to wait for the decision of FTT for permission to apply to UT before sending your spousal visa application.

I got reply from ftt they didn't give us permission
can I apply for british partner within 28 days now bcz I don't want to go to ut now

@ HNJ, yes you can submit a fresh application now, but in my opinion its better for the appeal process to be on-going and for you to withdraw it yourself before submitting fresh application. The reason why i suggest this is because HO do make silly mistakes with appeal completion date sometimes and its better to be on the safer side.

Just send in permission letter directly to Upper tribunal while you are making preparation for your spousal application and get a solicitor to help you identify error on point of law in the FTT decision.
