Tier 1 (Entrepreneur)

Hi Guys

My grandmother recently passed away and my grandfather is in hospital due to this I have been out of UK since 27/JAN/2016. In total including today is 83rd day (out of country).

Im writing this from my home country. Im on tier 1 entrepreneur extension visa my ILR is due next year in OCT/2017

Can I stay out off UK for more then 90 days in one stretch ? Or will it be an issues at time of my ILR ?

Over 90 days' is usually grounds for refusal.
The days of travel are not considered part of the 90 days.

No issue at all. The 90 day limit was abolished a few years ago.

PBS migrants are permitted 180 days absence per 12 month cycle.

Sorry about this just dont want to get in trouble at the time of ILR.

How can I be sure about this ? Do you guys have any link i can go through ? I have gone through the T1 Ent Guidance it says 180 day nothing mention about 90 days but still want to be sure .

You won't find it because there is no limit of 90 days and hasn't been for a long time.

90 days absence does however apply to citizenship applications.

So in oct 2017 I am due for my ILR and I suppose in oct 2018 I will be due for citizenship (year after ILR) ? So you mean to say if now Im out off country for more then 90 days it will be a problem at time of citizenship ?

Naturalisation: Check if you can apply

You are allowed to be absent for max 180 days in each year of your qualifying period during your Tier 1 visa.There is no such a thing as 90 days rules for ILR.
However you must not be absent for more than 90 days in 12 months before your apply for naturalisation (90 days absence when you are on ILR)

Bit Confused. What does following means ?

Pre 6 April 2014 transitional arrangement (T1 -Ent Policy guidance - page-61 -point 169 )
"If you successfully applied to enter the route before 6 April 2014, and you are making an extension application or a 5 year settlement application, you may continue to employ:
 one worker for 24 months
 one worker for 6 months and one for 18 months
 4 workers for 6 months each and score points for job creation."
I changed my Visa from PSW to Tier 1-Entrepreneur-50K in OCT 2012 and got my Tier 1-Ent EXTENSION in OCT 2015. I will be applying for ILR next year in OCT 2017.

1- Does this means I come under Pre 6 April 2014 transitional arrangement ?

2- To meet the T1 Ent extension to ILR requirements I have 2 full time employees working 30 Hours per week at the moment. Wondering if I take on one more full time employee for 4 months. Will that bring the period of 12 months down to 10 months ?

You need to create 24 months of employment under transitional arrangements. If you hire more people you will satisfy the criteria sooner but you still have to wait up to 28 days before your 5 years is up to be eligible to apply for ILR.
