Tier 1 Extension Employment (route before 6 April 2014)

Hi Guys,

Please help. I am a bit confused. I have entered Tier 1 Entrepreneur route before 6 April 2014. I have one employee doing 80 hours a month since May 2014. As business required I got another employee starting Feb 2015 doing 80 hours a month. So one employee is under business since 17 months which is continuing and the next one has been in since 7 months. As you can see the employment has not been continuous.

My understanding as per the guidelines were we can employee people for the business and the total hours employed should be equal to 2 full time employees (30 / week).

i.e 30 hours * 52 weeks = 1560 hours x 2 employees makes it a total of 3120 hours.

I am almost 7 months away from extension and when reading posts I get the feeling if I got it wrong... Please advice, really in a confused state. :shock:

As long as there is no break in a job, it is continuous, doesn't matter when your organization created that particular position. I do not understand what you exactly inferring to and don't see any problem.

I think the continuity for 12 months is for those who got visa after April 2014 ,anyone before that date could do the mix and number of continuous months could be different or may be 6,12,18,or 24 Months consecetivly etc

In my understanding yes you need to produce at least 3120 hours of employment. In your case you can do this with one employ by hiring him/her for two years. Hope this helps.

Thank you for your reply, I was confused because the job I have offered is a part time of 20 hours per week and not 30 hours as per the full time they have mentioned.

Thank you Ahmed25 for your reply. When I total the whole hours it adds up to 3120, but it is formed of part timers at different periods over the past years.

i am not an expert but based on my understanding the hours have nothing to do with it. Doesnt matter if your employee is doing 120 hours in a month, all the HO will consider is 30 hours a week and employment for 12 months.

now in ur criteria 17 months of FT employment for 1 employee and 7 months of FT employment satisfies the criteria for creating 2 FT jobs for 24 months (2 years)

if this keeps continuing like this, you will have a simple extension
