TIER 2 TO TIER1 ENTREPRENEUR

Post by soma7474 » Sat Jan 30, 2016 11:07 pm

Dear: Members

One of my friend entered in this country as TIER 2 migrant. His visa was granted until august 2014. he applied for DRF1 IN JULY 2014, But unfortunately application was refused on September 2014 without right of appeal, in the mean time he applied for right of appeal, court granted right of appeal. afterwards appeal was dismissed in may 2015, he again applied for same application in June 2015, the application is again refused in December 2015. he appeal against the decision again, Now appeal is pending to date.

He want to switch in to tier 1 entrepreneur, but he is confused his 3c and 3 d is still continue or break? because home office says you applied for application before your visa expiry and you get appeal right twice your 3c is still valid.

What is DRF1 and what was the reason for refusal?

Don't assume that everyone understands what you are trying to ask. Many probably don't so won't offer advice.

+1 on what noajthan said

These two (bold) are provisions within the rules for existing leave conditions to continue if leave expires and you have either submitted an extension or an appeal.

Also curious what DRF1 is though

In the context of EU immigration, DRF1 is an application form for a Derivative Residence card:

Not sure that makes sense in the context of this post.

Dear: noajthan

yes you are right about DRF 1.

But can you answer my question about 3c and 3d.

Entered IN UK: JULY 2011
VISA UNTILL: AUGUST 2014
APPLIED FOR DRF 1 IN JUNE 2014
REFUSED SEPTEMBER 2014 WITH RIGHT OF APPEAL
MAY 2015 APPEAL DISMISSED
APPLIED AGAIN DRF 1 WITHIN 28 DAYS
REFUSED AGAIN IN DECEMBER 2015
AGAIN APPEAL IN DECEMBER 2015
CAN HE MAKE TIER 1 ENTREPRENEUR APPLICATION

SOLICITOR ADVISED SUBMIT FRESH APPLICATION OF TIER 1 ENTREPRENEUR AND WITHDRAW APPEAL ONCE APPLICATION RECEIVED BY HOME OFFICE

Can you please stop posting in CAPITAL letters. It is the same as shouting.

On what basis did your 'friend' apply for a derivative residence card and based on who?
