Tier1 appeal and ILR

Post by ali20000 » Mon Mar 09, 2015 3:05 am

Dear users,
Please find my time line for your better understanding.
15Feb14: applied T1 application from PSW ( in time)
28May14: application refused with appeal right.
19Nov14: FTT hearing.
26Nov14: FTTrefused.
08Dec14: Permission to appeal (FTT)
27Jan15: Permission to appeal dismissed
08Feb15: Applied Upper Tribunal for Permission to appeal
12Feb15: received acknowledgement
Waiting for decision
My 10 years will be completed next year (April 2016).
I am struggling to find an alternative option so my 10 year chain won't be broken.
If the decision from upper tribunal is against me then I am thinking to apply FLR FP (not married and not in relationship here in uk). If FLR FP is also refused, will I be able to apply ILR prior the completion of 10 years.
Any response will be greatly appreciated.

***** its better to discuss your case in detail as it is a sensitive matter once you get UT refusal

Hello Experts,
I have received a decision from UT and refused on 12 May.
I have nearly 10 months remaining to complete 10 years.

In the letter, it was stated as below.

This is to inform you that the Upper Tribunal has refused or not admitted your application for permission to appeal to
the Upper Tribunal.
The reasons for the decision are enclosed herewith.
There is no further right of appeal in these circumstances. A decision by the Upper Tribunal refusing permission to appeal
to itself is an "excluded decision" and therefore no appeal lies from such a decision to the Court of Appeal: s13(8)(c)
Tribunals, Courts and Enforcement Act 2007.

I am confused now what to do?
1: Can I appeal (IAUT1)? and my long residency will not effected?
2: Is there any other application to file? i.e FLRO

Please advise, will be grateful.
