upper tribunal experience

Hi,

Just wanted some idea regarding my appeal

Visa was refued due to 50,000 not available on same date. showed two bank statments 25000 in uk 17th March 14 and 19th March 14 25000. FTT apeal won

Had my upper tribunal today. Not sure how it went but judge was nice, He listened to every thing. We proved las time that funds were not transfered from one account to another. Judge took that Into account today. Home office lawyer said we dont fall in law. Judge asked where does it say that funds should be available same date in which HO rep said it does not mention that it should be on same date but should not overlap.
Our last appeal was granted based on common law of fairness. I had a very serious operation so also medical condition was also considered at FTT.

Judge checked if we still have access to 50,000 which we agan produced with at UTT.

The Upper tribunal will send his decison in writing

any idea if based on the infromation the UTT can dimiss HO appeal?

without getting into any thick analysis I feel this tribunal will uphold 1st tribunal's decision based up on argument that there is not any guidance available applicant to follow that shown money to be available by providing documents dated same day.

Well basically If i am lucky I could based on fairness.

HO Rep said not mentioned of same date but should overlap.

I don't know if someone els have been refued on the same date issue.

We cleared that the money was never transfered from any account.

Anyone with same issue please share your experience

when ur appeal in ist tier allowed?
when home office challenged?
when u get acknowledgment letter from upper tribunal?
when permission granted to home office?
and how long it took for hearing after permission granted to home office? please

My FTT appeal was sucessful

FTT appeal hearing 18th september 2014
FTT jugdement recived 5th Nov 2014 (Appeal allowed)
HO appeal to FTT to go to UPPER TRIBUNAL 10th Nov 2014 (HO challanged the FTT decision within 5 days)
Premission allowed to go to upper tribunal 18th Novermber
Received hearing date at upper tribunal for 6th Jan 2014

Hear was on 6th Jan 2014
