urgent TOIEC VISA REFUSED

my timeline

Oct 2013
refused Feb 2014
appeal allow sep 2014

toiec refusal oct 2015 just got email from Solicitor

General ground of refusal under section 3221(A)

using voice verification software, ETS is able to detect when single person is taking multiple tests 

Future application for entry clearance or leave to enter the uk will not be refused under paragraph 320(7b)

if you are making application as

a spouce civil partner or unmarried or same sex partner under pariah 281 or 295 a of the immigration rules

a fiance or proposed civil partner under pariah 290

a parent, grand parent or other dependent relative under pariah 317

a person exercising right of access to a child under pariah 246 or

or

a spouce civil partner unmarried or same sex partner of refugee or person with humanitarian protection under paragraph 352 a, 352aa, 352 fa or 352fd

appeal right given

My 5yrs old daughter have AUTISM AND IS IN SPECIAL NEED ALSO IS THIS HELP TO ME

ten years going to complete in july15

Did you used a proxy for your test or you sat your self? Please be honest as you will be relying on these facts on your appeal.

Yes I sat myself at Portsmouth International College

Even

Home office mentioned my certificate number with
Name of college in refusal reason of proxy

I am a bit confused as if appeal was allowed then why its refused again?

Yes appeal was allowed when after 8months we chased ,home office said all TOIEC applicants are under consideration because BBC panorama.

I am genuine , no proxy

As I mentioned shall I also mentioned in appeal about my daughter Autism case
And
My ten years are going to be complete in 8 months

Please reply , where are Guru's

My question was meant to ask that if the original refusal was also about TOIEC or some other reason in which your appeal was allowed?

Are you using any solicitor?

My advise is don't scare and try to show them that you genuinely took the test yourself. If you did nay test after this one you can show that you have ability to sit and pass test yourself.

Expect to be asked questions like contents and format of test / test fee / center location and how did you perform and results.

Be confident and you should be good.

The Home Office are presumably going to use the 'voice recognition' evidence against your defence that you sat the test yourself.

+1 and as HO can afford the cost of the intense and special investigation, they would have used top expertise in regards to this issue.

"The basic technology extracts biometric features from an individual's speech to generate voice print (the voice equivalent of a finger print). I was replying to OP.

You need next 8 months. Depending on your location and local case loads in tribunal you can get hearing in next 6 to 7 months. Have you already filed that and what are your grounds?

I am using same solicitor who does my application and arrange barrister for me last time but he is very expensive

If any body have good and affordable please let me know

My ten yrs are going to complete in July 16 and

My daughter is going to be seven in December

Any above help Me in this case as I am genuine and never done proxy for other

Normally it would be better to find a solicitor near the are where your case is listed for hearing or vice versa. If you never have used a proxy and never been a proxy for some other then prepare good defence against short comings of this system and try to prove you did not need to take a test based on proxy and if that issue is general for all applicants or there are some reports against you specifically. Try to show that you should not be penalized due to some machine which is not free fr errors.

Tangy 67 - you say you sat the test at the Portsmouth International College - was that in Portsmouth or London? I ask because I see that it's in the list of colleges that had its licence revoked by the Home Office and I need to know if that was the college in Portsmouth, or another one in London.
