Age points, qualification points, income band - confused?

Post by geriatrix » Thu Nov 24, 2011 6:31 pm

Date of application or date of issue of leave!

Are you confused which one is relevant and therefore cannot determine the points you score for the various relevant attributes (e.g. - age, bachelor's degree, income band) with regards to your leave to remain (extension) application as Tier 1 (General) migrant or settlement application?

The only date that is of any relevance is the date of application, i.e. - the date on which you applied for either HSMP approval or Tier 1 (General) the very first time (leading to a successful grant of leave with / without an appeal or administrative review).
Why? - Because the immigration rules and policy that you are subject to depends on this date and this date alone, in context of both extension application and settlement application.

Never jump to using the PBS calculator before reading the policy guidance first because more often than not the confusion(s) exist(s) because of ignorance about what the policy guidance says on the issue in question.
1. PBS calculator works on the basis of inputs you provide.
2. To ascertain whether your inputs are accurate, you need to read the policy guidance first.

Likewise, read the policy guidance before filling up the form. Hint: Search for the phrase "under the rules in place" in the policy guidance.

Points for age

Post by geriatrix » Sun Jun 17, 2012 5:13 pm

It is perplexing to see so many high-value migrants unable to answer the question "how many points will I get for my age when I apply for extension" themselves.

The only reasons one can think of for such an outcome are that:
1. no effort has been made to read the policy guidance, or
2. no effort has been made to even read the relevant question in the application form.
3. no effort has been made to read the the post above.
4. no effort has been made to search the forum for information already available.

Here's what the guidance states:
Tier 1 (General) policy guidance wrote:53. If the applicant was first granted leave in the categories of Highly Skilled Migrant, Writer, Composter or Artist, Self -employed lawyer or Tier 1 (General) Migrant and has not been granted leave in any category other than those listed here since the first grant of leave, points will be awarded based on the applicant’s age at the date of the application for that first grant of leave.
Here's how the relevant question begins in the application form:
Tier 1 (General) application form wrote:G1. Please tick the relevant box to confirm the points claimed by the applicant on the basis of his/her age at the date of application for the first grant of leave in the category.
It doesn't ask the applicant to calculate the points based on the applicant's age at a given point in time but simply asks the applicant to confirm the points he claimed at the time of the first application? Could the question have been more simpler than this?

Why are some people not able to understand these two statements - written in plain English and in manner that could not have been more simpler or straight-forward? Beyond many of those who keep answering this question time and again!
