Child Under 18, ILR or direct citizinship

Post by jamil_imboards » Thu Nov 12, 2015 11:35 am

Tier 1(General) Main Applicant:
First Visa: 12/01/2011- 12/01/2013
Extension: 14/02/2013 – 12/02/2016
Dependant 1 (Wife): 14/02/2013 – 12/02/2016
Dependant 2 (Child under 18): 02/09/2014 – 12/02/2016

Hi,

My Main query is about my daughter ILR (Indefinite Leave to Remain/Settlement) or citizenship

I am main applicant on tier 1 general. My wife firstly joined me as dependent on 16 May 2012 and then she had visa extension with me which was from Feb 2013 – Feb 2016.

1. According to UKBA rules on their website she can apply ILR with me, as she is living in UK for at least 2 years? (This is quite clear)

https://www.gov.uk/settle-in-the-uk/y/y ... neral-visa

(they’ve been living in the UK with you for at least 2 years if they applied before 9 July 2012 or 5 years if they applied on or after 9 July 2012)

Now the question is about my daughter. She born in October 2015, When I was on Tier 1(General).

2. Do I have to apply ILR for her as well before citizenship or can I skip?
3. Can she apply for Application for registration of a child under 18 as British citizen: form MN1 after parents ILR?

UKBA Reference: Eligibility for child under 18 to apply for citizenship

section 1 (3) birth in the UK to parents who are now settled in the UK or have become British citizens.

If the child was born in the UK, then you can skip ILR and register on MN1 once you get ILR.
