How can I cancel my spouse dependent visa

How can I cancel my spouse dependent visa

Hi

I came UK on HSMP visa in october 2005. I got married in India in April 2007 and my spouse got dependent visa and arrived UK on 22 Aug 2007. Now due to few problems we are seperated. She is still in the UK and not willing to go back India. Because she is not capable enough to get a job since now and its been difficult for me to take her responsibilities anymore.

Can anyone suggest me what should I do in order to get her Visa Canceled by the home office?

What should I do?

Hi Mr.Patel,

The VISA once issued can only be cancelled at the discretion of the applicant on whose name the VISA has been issued....

The Home office/BIA cannot be cancelled on compassionate or personal grounds rather it should be impending to the homeoffice in order to process.......

I believe it might be difficult for you to do this.........

Why don't you find an alternative to find her employment......

As the saying goes --WHERE THERE IS A WILL THERE IS A WAY--

I am sure that ultimately u can find some solution rather than cancelling her VISA for no mistake of her's...

This is all crap. the basic rule of a dependant visa is that your spouse is dependant on you.

dependant is...
1. Married to you
2. Partner to you

you need to inform the Home office about your seperation and take necesary steps. After seperation from you legally she is illegaly living in the UK.

Read the HSMP rules carefully. it is all stated there.

Send a copy of the letter to Border and Immigration as well so you're covered, just in case anything happens in the future.

Hopefully it wont, but it's better to be safe than sorry.

Why not to leave her alone till her visa gets expired? Then she will have no choice but go home.
