ILR - No Job for first 5 months in 5 years

Post by strongleap » Wed Jan 21, 2015 7:05 pm

Hi all,

I am about to apply for ILR end of June 2015 as Tier 1 General applicant.
But I have an important query to clear off my mind before deciding to go for ILR.

I came to UK in August 2010, while my visa started in July 2010.
I got my first job in September 2010 and it ended in December 2010. Its a short term contract and gone through a umbrella company.

I had to visit India, between end of December and 20th Jan 2011.

I got my permanent job in April 2011.

My question is :

1) I have no job between, August - September 2010, and December 2010 - April 2011.
2) I have been out of country between December 2010 and 20th Jan 2011, while I have no job. I cannot provide any employer letter for this absence.

Am I eligible to apply for ILR in June 2015 under continuous 5 year residence rule?

Else is it advisable to go for Tier 1 extension before April 2015 and wait till April 2015, so that I have continuous employment criteria for 5 years?

Guru's please advise me with your expertise.

Thanks a lot well in advance.

Anil

Yes, As long as you fulfill earnings and other criteria, i do not see any problem.

1. I was unemployed for the first four months, but in continuous employment since then and had successful ILR.
2. Short absences are okay, if you are away for more than 180 days during one interval year then you should be worried.
