Please help - ILR - dates and previous earnings

Hi

I'm planning my ILR application in March. Please help with below questions: Thank you very much in advance!

· Current visa status: Tier 1 (General)
· The date of first grant: 15 April 2010
· The date entered UK: 18 June 2010
· Extension made and granted on 18 Mar 2013
· Current visa expiry: 15 April 2015

Questions:

1. Can I consider to be completing the qualifying 5 years period on 14 April 2015 (15 April 2010 – 14 April 2015)?

2. If I will complete the qualifying period on 14 April 2015, can I submit my ILR application on 17 Mar 2015 via premium service centre (28 days before 14 April 2015)?

(The reason for the above 2 questions was because I have concerns about claiming enough points on my previous earning. I need the income on the month of Dec 2013 to be included as part of my previous earnings to claim 15 points of having more than £20,000 in the claim period. )

3. Based on below salary/payment details, will the whole amount for the month of Dec 2013 be included as part of previous earning claimed? Or only the amount covering 17 Dec – 31Dec could be included? In this case, how will it be calculated given that the amount showed on both the pay slip and the bank statement was for the whole month?

If I submit the application on 17 Mar 2015, so I can claim points for the period 17 Dec 2013 – 16 Dec 2014 (up to 12 moth period from the 15 months immediately before the date of the application). The income for the month of Dec 2013 was dated on 17th Dec on the pay slip and also received on the same date showed on the bank statement.

4. Are overtime payments counted as part of the previous earnings? (They are taxed and showed on the monthly pay slips.)

Why not claim from 1st Jan 2014 to 31st Dec 2014 if you are planning to attend PEO in 17th March ?

regarding the 3rd question and why not claim from 1st Jan 2014 to 31st Dec 2014 if you are planning to attend PEO in 17th March ?

I can actually be able to claim points only between 17 Dec 2013 and 30 June 2014, as I left the previous employer and have been studying with no income since July. Although I'm starting a new job in Feb, claiming points for the period (17/12/2013 - 30/06/2014) is still a better option for me to have enough points. can you please advise in my case if they would consider the whole salary amount of Dec 2013 or the amount covering 17 Dec – 31Dec will be calculated and only be included ? how will they calculate this? per calendar days or working days in the month?

are you including the payslips for JAN 15, FEB 15?

Your Finances
Evidence of your finances. If you have to complete section 5, bank statements, building
society savings book(s), pay slips or other formal documents as evidence of your ability to
maintain and accommodate yourself and any dependants without recourse to public funds.
(See Note 5).
Note 5 We do not accept internet or cashpoint statements as evidence of finances. If you claim
that a relative or friend is providing you with financial support (see question 5.4), in addition to
evidence of your own finances, you must provide bank statements or other documents of the
kind described above as evidence of their financial resources. The documents showing the
finances available to you and to any person supporting you should cover at least the last three
months.
