Tier 1 2nd extension period?

Post by ahmed123786 » Sun Oct 19, 2014 2:30 am

Hi,
Hope you are good. I have got two questions if you can answer me i will be grateful to you.

I was granted 3 year tier 1 visa in september 2010 (but i was considered BEFORE april 2010 case because i applied and submitted my application in Feb 2010 and got the visa in Sept 2010 after i did administrative review ).

Question no 1 :- i came here in UK after spending 2 years (730 days)->back home because my father was ill and heart patient.
Arrival in UK under Tier 1 General Category:- Sept 2012.

Then i got my first extension in Sept 2013 for 2 years and my visa expires in september 2015. So my case was 3+2.

If i apply for second extension in March 2015 or near april 2015, i am wondering will i be able to get 2 years visa extension for second time? . IF yes then still i am short of 6 months to make 5 years of ILR and lets say if they grant me visa extension until March 2017 then i can not extend it further because of the new rule and i will not be able to apply for ILR as well because at that time i will not be completing 5 years for ILR

Question 2:- Can i apply for ILR in september 2015 straight way under compassionate grounds ?and i have medical proof of my father serious illness for 2 years as well

Could you please help me in this regard?

Thanks in advance

Q1. You will, in any case have to go for second extension before april 2015. You should get extension for 3 years this time. In case for some reason you are given 2 years extension, then obviously you will not be eligible for ILR.

Q2. NO.

If this gets implemented, then many people will hv some relief (subject to any conditions)

Thanks for your prompt reply .much appreciated . So it means that it will not matter if i applied my case before April 2010 (3+2 case) even then after approval of 20th October rule in order to cover my 5 year for ILR I will get 3 year extension no matter I applied before or after April 2010 for the first time ???? But in this way they will definitely have accountability factor on how many days missed or still needed for ILR .i hardly see this when it comes to extending your tier 1 extension
