Tier 1 dependent extension in India

Tier 1 dependent extension in India

Hi all,
Me and my wife are currently in UK on Tier 1 (General) and Tier 1 (Dependent) respectively. We were recently blessed with a baby girl and my wife wants to travel to India.

While she is in India, I am planning to apply for my Tier 1 (General) extension. Is it then possible for my wife to apply for an extension in India and a new dependent visa for the baby or do we have to get the extension before she leaves.

Would appreciate any input

From my understanding, I think your wife can apply for extension in india, after you have got your extension.
The fees is also less if your wife applies for extension outside UK.

No, you cant do extension in india. You will be resetting ILR clock if you do so.

Do you have any known experiences ? Even i got scared to do previously, My wife came UK to extend her visa. But when i called UKBA helpline they told as you. But one of our immigration solicitor told me that, Before expiring your current visa, If she was able to extend there is no issues.

Keep in mind that you are not basically extending, It was a similar to fresh application, there are lot of dependent visa's from out side country getting rejected. So If you feel ILR is more priority than money do it in UK.

Hi Stalwar

No need to worry, You can do is and save money from your visa fee as well. Make you sure you are extending your visa bit earlier and you can ask your spouse to apply for extension once yours is granted. Two things to make sure

1. She whould not file the application before you extend your visa
2. She should file her application with in 28 days of her visa expiry

If her visa expires and filed after 28 days then her ILR clock will reset. Refer the below document

From the last post in your 1st link, and also from cutevedha's post, if you read pg27 of calculating continuous period, it does appear that applicant should be fine to extend her visa from India, as long it is prior to expiry of current visa or within 28 days of expiry.

Looks like its possible i.e. excerpt from the link given above :-

If the applicant’s leave expires whilst they are outside the UK and they apply for entry
clearance within 28 days, the applicant’s continuous period is not broken. In this
circumstance, if they successfully get a new grant of entry clearance, the period spent
outside of the UK will count towards the 180 days allowable absence.

What makes you to think that it is not possible, Don't follow or believe in any one including me. Just follow their guidance and if it is clear then its 100% possible. If you are not clear from the guidance then send an email to UKBA and confirm with them. In forums we need give clarify some one's question if possible with a reference document. I feel we should not put our assumptions and thinkings to confuse who desparately need an answer.
