Tier 1 General April Extn 2015 Rule + 3 months extention

Post by mrvaibhavpanchal » Sat Apr 12, 2014 6:38 am

Hi,

My Tier 1 was granted on 09/11/2014.
My first entry of clearance in the UK was 25/02/2011 (after 108 days from visa granted)
My visa expires on 24/01/2016 (A total of 4 years, 10 months, 30 days stay in the UK).

Am I eligible to apply for ILR in January?

If not, I was told I can only apply for Tier 1 extensions within 3 months of my Tier 1 expiry (i.e. 24/10/2015 which is past April deadline). Can I apply my Tier 1 extension lets say in June 2014 (to get extended to 2017)?

Any help would be "highly" appreciated. I can see that there are other posts such as http://www.immigrationboards.com/uk-tie ... 45715.html which mentions about the same topic but they are very confusing and going in multiple tangents.

I would highly appreciate (for the benefit of all other people like me) if its possible to get a yes or no answer followed by any explaination, any possible workarounds.

I wouldn't be able to thank enough to anyone who can help me here.

I got 2yrs for 2nd extension. Most of my friends with same timelines got 3 yrs. So the duration of extension was not consistent. So keep this in mind and calculate and then go for extension.

@haiksuresh: Thanks for lot for replying. How long before the expiry did you apply for the second extension?

Hello All,

Help wanted!!!

I applied for my initial Tier 1 visa on 9th of July 2010 and received it on 30th July 2010. Came into the UK 2nd October 2010. My challenge now is that I will be due for ILR 2015 but have long absence total 283 which is 103 days more than the accepted 180 days between November 2012 and August 2013. Can I seek for another extension or I will not stand a chance of getting it since my absences are for personal family issues.

Advice on how to proceed is desperately needed please....

Assuming you dont have any other long absences in 2012 and 2013, you need to split the 283 days between two years so that you satisfy the condition of not being out of the country for any single year over 180 days. For this you have to calculate the 5 years backward from the date of your ILR application (see page 19 of https://www.gov.uk/government/uploads/s ... eriods.pdf).

Ade76 / Ram80: I believe you can only split if this is made up of multiple visits. If all 283 days were in a single visit, the continuous period is reset. i.e. any single absence of more than 180 days resets the period.

Thanks Guys for the response. The absence falls in one calender year with two weeks breaks in between making it 113 days and 170 days. Thats the challenge. Is it possible to go for further extension?
