@Go12 ok thnx for info, i entered on July 2011, so technically i am behind you in queue.
Reason i asked, if we don't mess up with timelines or rules, we should be OK. It seems like i am one of last Tier-1 to enter?

@amahed thanks for joining. Since it's closed group wait for Admin Ram Sury to accept you. That group was originally created in reaction to last year's FEE increase, but to be honest participants are not really encouraging. Still Ram Sury has all info and action plan in arsenal to go ahead and challenge Home Office. Only problem, which is very big one is FUNDs.

Thanks Abhishek,

Can you or any other senior member can help to answer following question;

My current leave to remain is expiring on Dec 2015, and i am short of 4 month to apply for ILR. Can I apply for early extension before 6th April 2015 let say in March 2015, because this help to cover the gap of 4 month. If yes the previous earning will be calculated 12 month from date of application or date of extension expiry.

Thanks

You can extend as early as possible, even now. I had same plan of going for extension early, since mine expiring on June-2015.
BUT i suggest to go even earlier like in Jan 2015, because of possibility of backlog of Tier-1 applications on last date rush.

Previous earning applies from date of application not expiry.

I think most of us will make the ILR boat if we go for early extensions.
But It becomes very unfair if we get a minor conviction just before ilr and then have no place to go.

Thanks Abhishek9

I think you are right to apply as early as in Jan 2015, just to be on safe side.....

I hope other people like us should be able to do this to avoid problems created by the date.

Exactly that's the point!! a simple traffic offence or a council dispute can escalate to court which will surely postpone ILR eligibility to minimum 24 months, as per latest criminality rule changes.
I wont even talk about out of country issue, but there can be case of contractors sitting idle/unemployed and wish to extend after April 2015, this rule is surely unfair for such scenarios?

Hi Argus7.......You've mentioned its Official now. What makes you say that?
Couldn't find anything on UKBA website. Read somewhere on Imm. board that it will be published on UKBA website after 6th April 2014.

You are right. I don't think HO has even given slight consideration to these scenarios.
I hope atleast we all get 3 years extension in our last application.

I don't know why they want to stop extensions in 2015 itself if they intend to close ilr in 2018. They could have milked more money all the way until at least 2017 which gives some buffer to the handful of us
(at the cost of hard earned after tax earnings)

Cant we take them to court for the reason that this rule was not there when we made initial application and as per rule at that time you can have 2nd and 3rd extensions

Hi Ram14esh

I am sure Tier 1 (General) dependants are not affected by these changes. Dependants can always apply/extend their visas. Unless board gurus have something specific to share. Thanks.

thanks for quick reply. You are right we will wait for experts and guru's of this forum to further comment and confirm this because in the addendum document in UKBA I didn't find any where saying it is applicable or not applicable for dependants. Guru's pls shed some light.

Anyone who wants to consider the court route should be aware that Judicial Reviews can cost tens of thousands of pounds. So let's say £50k.

How many here are willing to contribute £500 each (we need a minimum of 100 such members).

A lot of us may be landing up in a soup due to these changes. Better to take it to court and oppose these changes..

We all should get 3 yrs irrespective of individual cases now. this issue has been tackled in various threads.

I would have preferred to be milked for money than making me rush towards finish line.
when did you enter UK? i think i am one of last to enter on July-2011, and most of members here are eligible before me, making me feel alone and isolated.

I believe from the first point in updated document(see below link) clears about dependants.."Dependants can still apply to join applicants who have obtained prior entry clearance for Tier 1 General."

Experts please comment.

 you too are standing before me in queue. just can't see anyone behind me

Just a note to everyone who still have more than a yr for ILR to be careful about 2 things
1) floating criminality threshold rules. Any mistake and inclusion into Criminal record will postpone ILR eligibility to 24 months minimum.
2) take care of out of country absences.

additional points are most welcome
