I beat all of you :) ( and not very proud of it )

My first entry was aug 2011. Didn't stay much. Came back in Nov 2011 and again same story.
Eventually entered again on 6th May 2012 and has been living here.

So I am hoping I will be able to apply around late 2016/Jan 2017 ( using the 180 day allowance)

my current visa expires in Oct 2016. So I will be applying 1.5 years earlier than expiry and this would be my 3rd extension.

so not sure what's in store for me.

We also arrived in August 2011, having taken time to secure employment before arriving. Original visa grant was November 2010.

I'm not overly worried about this as I've been expecting it pretty much from the start, it's a defunct visa category and the current government is obsessed with bringing down net immigration (impossible while they are in the EU). So it was always coming. It has been important to be prepared and not rely on endless extensions.

As it is we will probably apply late this year for a second extension (so a year early) and will be eligible for ILR in late 2016.

My only worries are threefold:

(1) they stop allowing early extensions
(2) issues with backlogs of applications and difficulties getting PEO appointments
(3) cracking down on ILR to make it even more impossible. Already it is ridiculous that you have to get a former employer to confirm you were allowed to go on a one week holiday abroad. Tier 1 visa holders are not even required to be employed the whole time so that rule is insane. How do you document a holiday abroad between jobs?

Worst case scenario is a shift to Tier 2, if necessary.

I do feel for people who have broken the continuous residence rule in this time or have minor traffic offences blocking ILR. I hope there will be a legal challenge. The current UK government is dreadful and has unfairly savaged non-EU immigration in its relentless quest to bring down a statistic it actually has no control of due to the influx of EU citizens.

Recently service has improved considerably. One of my friend got extension in 3 weeks duration via postal, with time including posting till he got approval/BRP. Also its very very easy now to get same day appointments. Only caveat is you have to pay upfront cost as well as security amount of £100.

Again this created lots of confusion, but consider 2 things:
1) recent approval of ILR in this forum, which also includes longer absences without employer proof.
2) if you read continuous period document https://www.gov.uk/government/uploads/s ... eriods.pdf
it clearly states less than 180 days in a single year (and not 90 days continuos) won't break continuity
I know same document asks for employer letter, but same document assures you haven't broken any continuity

Looks like even i have to start looking for Tier-2 General options.
If you have not noticed, they are being favored from 06 April 2014, by giving 5 years validity which earlier was 3 years. Also cannot see ILR closing for them. Also their fees is far less compared to ours

I Dont see much of hope among the people on this forum and why it would be and for obvious reason.

Has anyone asked any solicitor or UKBA itself that we can for early extension or it is just an understanding by looking at the documents that we can go for early extensions.

Does not break continuity?but of course if we have entered within 90 day bracket

I have seen ppl getting ILR,with continuous 180 days absences outside.so this is such a grey area.they can't stop early extensions,I mean that's expected,we have no choice,we can send it atleast by post.
Plz clarify.

I can understand, but don't lose hope so soon. Let's keep trying. Most of people who are concerned are those who still have around 2 years left to be eligible for ILR, and rest are planning to go in a year so don't care to come together.

@Go12 may be my bad english :(
90 days will break the period.
less than 180 days AND NO continuous 90 days out of country need to be in a single year. In another words should not be out for continue-sly for 90 days. make sense now?

I didnt get your last line "and rest are planning to go in a year so don't care to come together" may be after all that is happening I have can't concentrate anymore :(

guys what's this 90 day continuous out of country rule now.

I thought this continuous absence is only broken by 180 days per year. Has something changed recently now ?

Even i lost some sense and feeling so angry since yesterday when i saw these changes.
clarifying disunity thing. Most of tier-1 (general) have entered before us, so they are due in a year. I know my friends who are too busy to be concerned with this thing, or just don't care. I am trying again to wake them up.

Silver Lining is: Ram Sury is very knowledgeable, and have even contacted HSMP forum who successfully fought case against UKBA. He has information and know-how on how to proceed with this case, and even confident of winning.
Problem: you know that fund is huge and response is poor.
Still i am trying. Even if lets assume we are hopeless, why not die fighting? lets ask everyone around and persuade them?

sorry for confusion. It was there earlier, but i cant see any longer there. Good it's not there and so not cause of concern

phew !

guys we need to have a clear agenda to fight the case. tier 1 applicants will be treated differently from hsmp.
tier is subjected to change and we all have signed this agreement while making the application

can we all think and come up with a very specific agenda/scenario.

tier1 was closed in april 2011. so there will be loads of applicants who will become eligible only in april 2016. technically anyone applying for ilr after april 2015 is at risk if they get a minor conviction just before they qualify. so we have handful of people like us. not many know and have thought about it.

have you joined the FB group? same question goes to @tier1extend?
personally i won't encourage such suggestion as we need to go for other options first like personal contributions, asking help from HSMP forum and moreover loans for such objectives may have its own difficulties?
I am not shooting down the idea down just lets move to FB group discussion?

Relax guys, we still have ample time before thinking of such moves, and i am confident we won't need it.

For Info: switching to Tier-2(General) will keep us on track for ILR, and allow to complete remaining time.
Tier-2(General) is work visa whose applicants can go for ILR after 5 yrs period. But as @tier1extend said not Tier-2(ICT).
@Go12 Tier-2(General) is not self-sponsored, and unfortunately we need to have someone to sponsor us.

But it's not panic situation, just extend once before April 2015 and play safe game till we get ILR. But don't forget our effort of confronting UKBA via legal means with help of Ram Sury. :)
Another request if you can encourage other migrants like us to join our FB group. 100 people though doesn't look daunting but also doesn't look motivating looking at way people are not coming forward, so lets see if we can find and include like minded people.
