Tier 1 General Shortage issue help required?

Post by mmc » Thu Aug 14, 2014 10:03 am

Hello Experts,

Long story short,

- Got Tier 1 Gen visa in April 2010,
- First entered on the 06th June 2010
- First exit on the 07 July 2010 (Was absent for about 56 days)
- 2nd time entered on the 04th of Sept 2010
- 2nd exit was on 13th Sept 2010, (Was absent for about 82 days)
- 3rd Entry was on the 04th of Dec 2010 and then no exists at all...

Total absentee in 2010 about 138 days and thereafter no absentee!

1- Question is Can I apply for my ILR in March ? Or Do I need one more extension
2- would the above absentee in the same year affect my ILR application ?

Your help will be really appreciated.

Thanks for your prompt reply, but if you look at the first entry was on the 06th of June 2010, wouldn't I be short of two months ? Can you clarify this please ?

No your entry in United Kingdom within 90 days grace time
it does not matter if someone enter in UK within 90 days of visa grant.

Thanks alot! So in Summary;

First visa issued on the 21 Mar 2010
First entered the country on the 06th of June and then subsequent two entries and exists total absence are; 77+56+82 = 215 days
77 is the first absence from the visa stamp till the entry date, therefore accumulative number of absence is 215 days! So I should be able to apply for ILR in Mar 2015 ?

Tier 1 General ILR Application:

I got my T1 General Visa on 17 October 2010, first entered the UK on 11 November 2010. Since then I was in and out the UK for many times. I'm planning to apply for ILR next year and I'm very confused about the following:

1- First question, I don't remember when did I leave the Uk as I'm almost traveling to my home country for work every month and my passport is full of stamps and the UKBA doesn't stamp the passport on departures, so I don't know when did I leave the UK and I can't calculate my absence periods accurately.

2- Second question, it took me a year after I got my visa to form a company and took me another year to start the actual work and another year to have regular expenses from my bank account as I moved permanently with my family to live in the UK in 2013. I couldn't find any requirements for economic history in the SET O guidance. Do I still qualify for ILR, what are the documents required to prove my economic activity? Do I have to supply this? I started receiving salary in 2012 (2 years after I got my visa). What are the documents for the economic activity and do I need to present any? I'm planning to apply with Premium service.

Please help, thanks
