Tier 1 General to ILR -- Very Confused

Post by olachidi » Wed Feb 03, 2016 8:26 pm

Hello All . Please I would appreciate if you could help clarify by confusion

I got my 1st - T1General visa on 15-Feb-2011

(by 13-Feb-2013 it was two years so I applied for a same day visa but I didn't get the visa same day. I got it 11-June-2013 ( i.e the 3yr extension))

Looking at the date of my 1st application (15-Feb-2011), my 5 year continues period will be completed by
15-Feb-2016 (although my current visa does not expires until 11-June-2016)

1) Can I apply by 15-Feb-2016 ?
2)if yes can I apply 28 days before 15-Feb-2016 ?

Thanks

1. Yes

2. Yes

What was the reason your visa extension was not issued on the day in 2013?

its was a very long story .. the case worker wanted more documentation for the income I claimed and evidence of my profession . Not a very typical case but I was able to produce all she required .

If you applied while your original visa was still valid, you would have been covered by section 3C, which means your visa conditions continue until they decide your application (same as if you apply by post).

I wasn't refunded for the premium fee I paid for same day application ... maybe I should have requested for this at the time ? but wasn't sure and more so I was solely focused on getting a positive outcome .

You wouldn't get a refund, even if you requested it.

Another confusing aspect

**Claiming earrings for 12 consecutive months of the last 15 months before the application
e.g
October -2014 to December 2015 = 15months ( I can only use 12 months within this period )

My question;
Can I claim any month within this 15 month period ?
e.g I pick October 2014 , skip November 2014 , pick December 2014 to November 2015

or does it have to be a consecutive months

e.g September-2014 to August -2015 or October- 2014 to October -2015

Hi I am on tier1 general. I am due to apply for ilr in april 2016. but my problem is that I have amended my tax return for the year 2012/2013 when I got the extension. I have partially paid the tax but not full to HMRC in 2012/2013. Now my point of worry is that, will it be a problem when i go for ilr in april? will HO object on why i never paid full tax in 2012/2013. Althogh I have declared full tax and waiting for hmrc. please help thanks.

hi my accountant has shown the income until 5th april of tax year 2012/2013 which is 5/6 thousand less than the income i shown to ukba as the accountant said that it falls in the next tax year in 2013/2014 not in tax year 2012/2013, is that right?
