Tier 1 to ILR (Re: new rule comes in by 6th of April 2015)

Post by James147 » Mon Jan 05, 2015 4:06 am

Hi Team,

I need expert advice on my Tier 1 (General) to ILR.

I came to UK as a student and later switched to Post study work visa, then to Tier1 General. I applied for Tier 1 General on 02/04/2010 and I was awarded Tier 1 visa based on immigration rule before 6th of April 2010 but my visa start date was 21/04/2010.
I am currently confused and don't know what to do with my Tier 1 (General), my visa will expire on 21st April 2015 and UK ukba has advised people to extend current visa because HSMP/Tier 1 migrant route is closing on 6th Apr-2015.
(On 6 April 2014 the Immigration Rules were amended to announce the closure of the route to extension applications from 5 April 2015 and to settlement applications from 5 April 2018. )

However, I am due for ILR on 21st April 2015 I need 32k as earning and I have enough income through salary to claim my point but my question / concern is can I apply for ILR directly using 28 Days grace before the end of my visa or should I apply for extension as form of security for my stay UK.

Please see brief details;

Visa Details:
Tier 1 (Post Study Work) : 30-April-2009 To 30-April-2011 (Switched to Tier 1 general)
Tier 1 (General) : 21-April-2010 To 21-April-2013
Tier 1 (General Extension) : 21-April-2013 to 21-April-2015

Holiday outside of UK

2010 - 14 days
2011 - 22 days
2013 - 18 days

Total days spent outside UK = 54 days throughout 5 years period

kindly advised ASAP.

Thanks

Hi Mate.

I not sure why you are so confused with this forthcoming rule.

after april 2015 no one will get T1 extensions, BUT it will not going to affect the ILR as you will be completing your 5 years before 2018

4/2015--- T1 extension closed
4/2018 ILR closed.

They are 2 different things so dont get confuse. you are fine as long as you complete your 5 years before 2018.

Thanks
A
Kind Regard,
A.Khan

Hi sushdmehta thank you very much , here is clearly mention maternity Allowance is not a benefit , so it will not effect on my ILR. thanks a lot for your kind co-operation.
