Time between Two Consecutive Extensions.

Hi,

Owing to the recent restriction on Tier 1 General Migrant Extension, I need to get my Two extensions done on the following dates:

A) 5-Feb-2015 through PEO
B) 5-April-2015 by Post or by PEO

My Query:

1. Is there any rule that restricts back to back Extension as listed above?
2. If apply by Post on in first week of April-2015 would there be any reason of UKBA not entertaining my application as it might reach them by 4-April-2015?

There is no rule in Policy which states anything against this.
Even if your post reaches as on 05 April 2015, UKBA will do entertain your application

BUT why back to back extensions? no offence but sounds foolish.

Right, Let me make sense out of it:

Following are my timelines:

1st Visa: 05-Feb-2010 Till 05-Feb-2013 (3 Years)
Started living in UK: 15-April-2012
1st Extension: 05-Feb-2013 - 05 Feb-2015 (2 Years)
ILR Date: 15-April-2017

Next Extension: which is on 05-Feb-2015, it could be of 2 Years or 3 Years depending upon the interpretation on Case worker of the Rule - mentioned under 245CB.

If Extension is of 3 Years (valid till 05-Feb-2018), that would be fine with me.

If Extension is of 2 Years (valid till 05-Feb-2017), then I will need another extension before 5-April-2015; as my ILR Date is 15-April-2017. Even if the 28 days rule is applied, I will need my visa to remain valid till 7-March-2017 which will not be the case with my 2 year extension. The other option would be to go for a postal application but it would be an option involving risk.

Now it makes sense why you are thinking so.
If you search forum, you will notice everyone are getting 3 yrs irrespective of rules placed for them based on date. So you should be good with just one further extension.
Moreover I would suggest you to go for same day at least for yourself as main applicant and sort this out with the case worker, in personal capacity.

Just a thought. Why not apply by post on Feb 05, 2015 And Pay by cheque.

If you see ILR timelines, it easily takes 3 months now a days to process ILR applications. If you apply by post on 5th Feb rather than PEO then your outcome will surely come in late april. And one more thing to keep in mind. Since the extensions are going to stop, there will be a rush of applications during that time so outcome will be even late. And mind you, the visa date will be from the day they make the decision.

Apply by Post, I would say. Will save you another extension.

Thanks for your kind response. Much appreciated.

The only downside I see by applying through post is: if they decide my case after 5-April-2015 and give me only two years of extension which would ofcourse give me no second chance for extension as all the extension would have been closed by then.

The only option that I would have left it in that scenario would be write to the case worker to give me three years extension instead of two but it all depends how case worker interpret 245CB.

I checked your dates again. And don't see why you are so worried with this option.

Even if you apply before 5th feb via post, I dont think you will get response before 15th April, 2015. Even if they give 2 year visa. after 15th April, 2015 you are still safe. As your qualifying period which started on 15th April 2012 will be more than 5 years.

Say, they make their decision early. You still have 28 days grace period at the end of the qualifying period. 2nd extension would be a waste of money in my opinion. But your choice my friend. The fees of Tier 1 general is an extortion. Think about it.

Your ILR due date will be 17th March 2017 i.e 28 days earlier to the 5 years. So you can send application via post on 4thFeb2015. After receiving biometric wait to 15 days and then give you biometric. So that even if they give 2 year extension you will be very near to ur ILR duration.
