Could you please advice on the following.
I was on Tier 1 (general) and my ILR application is refused few months back on 322(5) Tax amendments. The JR is progress. My family would be over stayers by the time we get the decision on JR. My spouse's employer is ready to process her work permit (Tier 2 General). My queries are as follows.
- 1. As we are overstaying for the Judicial Review, would UKVI approve her T2 application in spite of her over stay?
2. If she gets her visa approved, what are my chances of succeeding my application as T2 dependant, because of 322(5) deception on my ILR application?
3. If T2 (general) is approved for her, would she be eligible for ILR after 5 yrs continuous stay
