Help Required Please.!!

Post by Jack&Jill » Tue Jan 17, 2017 1:00 pm

Dear Gurus/Experts,

I'm on Tier 2 General working for my present employer. Few days before the employer made a decision to close the company because of financial trouble. But not officially announced; they told everyone not to come to office through text. I've not resigned yet nor the employer not even terminated. Last week they blocked my email communication; This Monday I've received P45 from my employer. In P45 it says Employee Leave date is 31/12/2016. What does it mean?

1. Is whether I'm still employed?

2. Does my sponsorship is cancelled?

3. Can I take legal action against my Employer for not letting me know about the present situation and notice?

Please advice. Thanks in advance.

1. No, your employment has been terminated.

2. Yes, your sponsor has withdrawn their sponsorship and terminated your employment.

3. Contact ACAS if you think you have a case.

1) No

2) Yes

3) You may if you have deep pockets.
Unlikely to get you anywhere.

You have 60 days maximum to find a new position and transfer to a new sponsor.
Good luck.

Thank you for your kind reply. Is the 60 days count from the leave date mentioned in P45 (or) when mentioned in the home office letter?
