Tier 2 Sponsor licence - Help required.

Post by snoopy01 » Tue Sep 01, 2015 12:04 pm

Hi, Our sponsor license was rejected for the following reasons:
Your application for a Tier 2 (General) sponsor license has been rejected for the following reason:

You have not supplied sufficient mandatory documentation as listed in Appendix A of Tier 2 Points Based System Guidance for Sponsors. In this case you have not provided all the information regarding your business and requested certificates of sponsorship (CoS), as listed on page 3 of Appendix A.

You have not provided sufficient information regarding question 6 (details of any applicants and why they were not suitable for the post of offer).

Additionally, you have not provided any answers to questions 8, 9 and 10 (WHERE ARE THESE QUESTIONS?)
I would really appreciate if someone senior who has successfully received a sponsor license.

Many Many Thanks!

So there is no one in such a famous immigration forum who can help us?
My questions are straight forward: What sort of evidence do we need to provide for the objection#1 which is "details of other applicants and why they were not selected" ?

The question is self explanatory so I am not sure what it is that you do not understand needs to be provided.

If you advertised a position and received applications which rejected as unsuitable, HO wants to know the details and why said person(s) were not selected for the position.

There is a reason they ask for this as some companies who have applied to sponsor a migrant, do so to sponsor friends and families or don't follow due process.

No RLMT required if switching from PSW to Tier 2. But meet minimum salary requirement of I think £20800.00.

Please see guidance https://www.gov.uk/government/uploads/s ... 4_2015.pdf

Page 28. Paragraph 100. Hope this helps.

Previous status is PSW or Student?

Post by snoopy01 » Fri Sep 25, 2015 12:13 am

Hi, I am currently hiring a person who say he is on PSW leave to remain. Here is the story.

1. Applied for PSW - PSW issued
2. Applied for Tier 1 (Entrepreneur) - Application Refused
3. Submitted appeal for above refusal.
4. Appeal withdrawn.
5. Applied for Tier 5 (based on a college)
6. Home office returned the application as invalid and refunded the fee (I dont know the reason for this)
7. Applicant went to judicial review.
8. Home office withdrawn from judicial review and asked applicant to withdraw their case.

What is the current status of this applicant?

I need to know this as I am going to sponsor this applicant under the Tier 2 route.

Many Thanks!

Home Office Visit Next Week!

Post by snoopy01 » Fri Oct 02, 2015 1:24 pm

Hi, We have applied for home office sponsor license in early september, and we are scheduled for a home office visit by home office person next week. Has anyone been through this, is this good news or bad news?

And finally, how long does it take to get an update after the visit?

Looking forward to your responses

Thanks!

Hi mate,

We had the same last year. A few people from home office came to our HR and spent a few hours with her checking all the paperwork. They have found some minor issues but advised they are happy with this and educated her on how to fix that minor issues.

Our company got the license on the next day of their visit.

I would say nothing bad will happen if the HR is prepared.

Many Thanks for the quick response VirtualWaver,

We are a very small company with only 2 employees (including me the director, the second employee is a british citizen) What sort of HR preparation do we need?

Thanks again!

Well I dont know that bit unfortunately as our company is very big and HR is working in other city, so I didn't really ask her for details. I believe all they want is to make sure that company meets the requirements as it says in policy guidance.

Hello,

We applied for the Sponsor License in the beginning of October and got it last week. Maybe that's because we sent in all the details including the RLMT at the time of application?

Hello,

We ere in the same situation. Just 3 of us. There are the documents we prepared:

1. All employment/ offer/ increment letters since inception
2. Attendance record for migrants
3. All leave requests and letters
4. All company papers related to Home office- Corp tax etc (that was submitted at the time of application)
5. Copies of everyone's pp and visas
6. RLMT ads/ interview notes etc (if applicable)

In regards to your own records:

1. Your qualifications- deg cert / reference letters exp letters
2. PP details/ contact numbers/ address/ next of kin
3. Your interview notes
4. Description of your duties

That is pretty much it. Hope it helps.

Just adding: The RLMT test notes as follows:

1. Listed all the candidates applied, their nationalities and WHY they were rejected
2. Short listed candidates who were interviewed : Why were they rejected
3. Keep a copy of all their CVs

I guess it's just safer to keep all these on the records, and submitting during application
