Tier 2 : Withdrawal of application Urgent!!

Post by darshanmehta2 » Sat Mar 08, 2014 3:06 pm

Hi,

I applied for UK Tier 2 work Visa 2 days ago. I submitted my application in VFS center on 6th March 2013. However, today I came to know that there is some wrong information in my application. I claimed the points for shortage of occupation of job whereas my employer has completed resident labor market test.

I contacted my employer and he told me that I need to withdraw my application on urgent basis and create a new one. My questions are:
1. Can the application get rejected due to this?
2. How can I withdraw my application urgently?
3. In how many days will I get my documents back (so that I can create a new application)?

Thanks in advance.

There is probably no need to withdraw your application, just to amend it. Check with the the VFS in the country you are applying from:
https://www.gov.uk/find-a-visa-application-centre

I would have thought that writing a letter addressed to the entry clearance officer at the UK embassy or high commission in the country you are applying would be quite sufficient. Say that you inadvertently ticked the wrong box in Appendix 5 (or on the online application) and would s/he please amend your application accordingly.

Hi Manci,

Thanks for the reply.

I applied from India. And, I don't know whether VFS center which I applied at supports such amendments. If that is possible then that would be great! However, I do not want my application to get rejected because that will mean the employer will have to assign a new CoS which he may not do.

If entry clearance officer finds out that I have checked the wrong checkbox (or filled incorrect info), will he straight away reject my application or I will be called for an interview? Any Idea?

you can contact the VFS:

West India: Email us Infouk.westin@vfshelpline.com
East India: Email us infouk.eastin@vfshelpline.com
North India: Email us infouk.northin@vfshelpline.com
South India: Email us infouk.southin@vfshelpline.com

Telephone enquiries:
You can call VFS Global on the helpline number: (022) 67866000. This helpline number will be available until 31 March 2014 only.

However, the VFS is just an intermediary, they don't decide applications, only transmit them to the UK High Commission. That is why I suggested you write directly to the ECO at the HC to amend your application:

British High Commission New Delhi
Shantipath, Chanakyapuri
New Delhi 110021
India

Email web.newdelhi@fco.gov.uk
General telephone +91 (11) 2419 2100 (24 hrs a day)

Hi Manci,

Thanks again.

I contacted British High Commission Delhi on below mentioned contact number. I described my problem, and they asked me to do the same inquiry at the office where I submitted the application. Apparently, they told that there is a form which is available at VFS office for such requests. I believe VFS office will not open before Monday. Hence, let me see what do they nave to say on this. I will call (and if needed, visit) them on Monday.

One more thing, is this possible to fill this form online? Because I do not stay in Ahmedabad and my city is 120 km away. I just wanted to check if there is way by which I can perform the same thing without visiting the office.

Thanks,
Darshan

the visa processing times at Ahmedabad are shown here:

It is important that your request for the amendment reaches the ECO before a decision is made, that is why I suggested that you write directly to the ECO at the HC. Make sure that your letter is delivered securely and asap.

Hi Manci,

Even if I write to ECO, how to make sure that the application reaches the intended officer? At max I can specify my application number in the letter. Will they hand it over to appropriate ECO? It seems risky as the officer may never get the letter.

I am planning to visit the VFS center in monday morning and will ask them to either amend or withdraw my application on urgent basis.

Will appreciate your thoughts on this.

Thanks,
Darshan

You would be writing to a department of the HC. There are several ECOs at the HC. Address your letter to the Entry Clearance Manager. The letter will be in their system if you have proof of delivery. Provide all personal details and the application reference No. Send a copy to VFS.

Does this mean I should send the letter via courier and ask the courier agency to have the proof of delivery? What is the preferable way? Should I send them via courier, fax or scan the letter and send them via email?

courier with confirmation of delivery + copy by fax.

Address the letter to the Chief Entry Clearance Officer

Hi Manci,

Thanks a lot for your help.

I sent an email to them with scanned and signed copy of amendment letter to British Council. They replied to me saying that they have attached both my email and letter with my application and will consider them.

I also sent the same letter to them via courier. Let me see what happens now.

Btw, thanks a ton again. You helped me through the most difficult times.

Hi Darshan,

Can I ask what was the outcome of your application to amend? Was it successful. I am in a similar position and am doing the same (thanks to manci's advice).
